This legal writing aims to understand the form of legal protection that can be provided to BRI Customers against crimes in the banking sector based on Article 55 paragraph (1) of the Financial Services Authority Regulation Number 22 of 2023 on Consumer and Community Protection in the Financial Services Sector and to analyze whether the LAPS Financial Services Sector or BPSK is authorized as an alternative Dispute resolution institution outside the court for resolving consumer disputes, especially in the banking sector.
The research in this Legal Writing utilizes a normative-empirical legal research approach. The analysis of this research is carried out qualitatively and described descriptively and arranged systematically to ensure that readers can easily understand the substance of this research comprehensively.
The research in this Legal Writing show internal and external legal protection efforts for BRI Customers and the responsibility of BRI as Finanial Services Institution and customers as consumers when crimes in the banking sector occurs. Furthermore, the subsequent research results show that the institution authorized to resolve consumer disputes outside the court, especially in the banking sector, is the LAPS Financial Services Sector because POJK Number 22 of 2023 concerning Consumer and Community Protection in the Financial Services Sector is an implementing regulation of Law Number 21 of 2011 concerning the Financial Services Authority which is more specific than Law Number 8 of 1999 concerning Consumer Protection which is the basis for BPSK's authority in resolving consumer disputes and this is in accordance with the principle of Lex Specialis Derogat Legi Generali.
