Musik merupakan bagian yang demikian penting dan sering dimanfaatkan untuk hal apapun, dari keperluan aktifitas sehari-hari sekedar mendengarkan musik sampai dengan kegiatan komersil seperti iklan dan kegiatan sejenis. Adanya media digital seperti Youtube, Spotify, Joox, dan lainnya, membuat masyarakat Indonesia semakin mudah untuk dapat menikmati musik tersebut kapan pun dan dimanapun mereka berada. Dengan mudahnya akses terhadap musik untuk dapat dinikmati dan dikonsumsi oleh masyarakat, maka peluang bisnis yang lahir dan berkembang pun semakin banyak khusus dibidang digital. Seiring dengan meningkatnya tren musik di dunia digital, maka lahir juga lah beberapa pelanggaran hukum yang terjadi baik yang dilakukan secara sengaja maupun tidak sengaja atau lalai. Hal tersebut membuat para pemilik karya cipta sangat merasa dirugikan baik secara moral maupun material. Salah satu pelanggaran yang marak terjadi di dunia digitalisasi khususnya pada platform youTube adalah Cover Lagu secara ilegal tanpa seizin dari Pencipta Lagu tersebut. Penelitian ini dilakukan oleh penulis bertujuan untuk mengetahui dan menganalisis perkembangan masalah Hak Ekonomi atas Lagu yang dicover di platform Youtube berdasarkan Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta. Lebih khusus guna meneliti mengetahui kepastian hukum yang bisa didapatkan oleh pencipta lagu berdasarkan Undang Nomor 28 Tahun 2014 tentang Hak Cipta, serta alternatif penyelesaian sengketa dan juga mekanisme yang harus diberikan pemerintah kepada pemegang hak cipta dalam hal ini adalah karya cipta Lagu. Sehingga hasil penelitian ini diharapkan akan memberikan manfaat kepada perkembangan ilmu pengetahuan di bidang hukum Hak Kekayaan Intelektual khususnya Hak Cipta. Penelitian ini pun diharapkan juga dapat memberikan manfaat bagi pencipta lagu yang merasakan permaslahan terkait cover ilegal di platform Youtube maupun platform sejenis dan dapat dijadikan acuan bagi pemerintah untuk bisa lebih peduli dan peka kepada pencipta lagu, serta memberikan alternatif solusi kepada para pencipta lagu dalam bentuk revisi peraturan dengan acuan penelitian ini.

Music is an important part which is commonly used for everything, from daily activities such as listening to music until commercial things such as advertisements and other activities. The existence of digital media such as YouTube, Spotify, Joox, and many others, makes it easier for Indonesian people to be able to enjoy listening to music anytime and anywhere. Because of the convenience to access the music that can be enjoyed and consumed by the public, so that many business opportunities are being born and developing, especially in the digital platform. Yet by the development of music in the digital platform, several legal violations were born whether on purpose or negligently. Consequently it will damage the copyrighted owners morally and materially. One of the violations that is frequently occur in the digital platform, especially on the YouTube, is covering songs illegally without the permission from the creator of the song. This research was conducted by the author aiming to find out and analyse the development of the problem of Economic Rights for Songs covered on the YouTube platform based on Law Number 28 of 2014 regarding Copyright. The research specifically find out the legal certainty that can be obtained by the songwriters based on Law Number 28 of 2014 regarding Copyright, as well as any alternatives to dispute resolution and also mechanisms that must be provided by the government to the copyright holders, in this case, the copyrighted songs. So that the purpose of this research generate benefits to the development of Intellectual Property Rights law, especially Copyright. The results of the research are also expected to provide benefits for songwriters they are who have problems to some illegal covers on the YouTube and any other similar platforms and can be used as a reference for the government to be more concerned and more sensitive to the songwriters, and provide alternative solutions to the songwriters in the form of revised regulation with reference to this research.
