PERLINDUNGAN HUKUM TERHADAP HAK CIPTA ATAS PENGGUNAAN CIPTAAN MUSIK DAN LAGU OLEH TELEVISI LOKAL DI YOGYAKARTA

Penelitian ini bertujuan untuk mengetahui pelaksanaan perlindungan hukum terhadap hak cipta atas penggunaan ciptaan musik dan lagu oleh televisi lokal di Yogyakarta dan untuk mengetahui kendala-kendala dalam pelaksanaan perlindungan hukum tersebut. Jenis penelitian ini adalah penelitian yuridis empris, dengan jenis data berupa data kepustakaan yang berupa buku, jurnal, artikel dan peraturan perundang-undangan dan didukung dengan penelitian lapangan dari hasil wawancara dengan narasumber dan responden. Pelaksanaan perlindungan hak cipta terhadap hak moral ciptaan lagu dan musik yang digunakan oleh televisi lokal di Yogyakarta sudah cukup baik, sedangkan perlindungan terhadap hak ekonomi belum berjalan dengan baik. Dalam pelaksanaan perlindungan hukum terhadap hak cipta tersebut masih ditemukan beberapa kendala. Sehingga diharapkan perlindungan hukum terhadap hak cipta tersebut dapat dilaksanakan dengan lebih maksimal, yaitu melalui perlindungan hukum secara pereventif dan represif.

This research aims to identify the legal protection implementation of copyright on the use of music and song creation by local television in yogyakarta and to know constraints in the implementation of the legal protection. This legal research is a juridical-empirical research, by the used of library research that supported by the field research . Library research obtained from documents such book, legal code, journals, article and kind of literature available with inteviews and field observation of such subjects. Implementation of copyright protection of the moral rights of creation of songs and music used by local television in Yogyakarta has been running pretty well, whereas the protection of economic rights have not been going. In the implementation of the legal protection of copyright is still found some obstacles. So expect protection against copyright law can be implemented with more leverage, which can be through legal protection, preventive and repressive.
