PERLINDUNGAN HUKUM TERHADAP PASIEN PESERTA JKN BPJS KESEHATAN DALAM PERJANJIAN KERJASAMA ANTARA BPJS KESEHATAN DENGAN RSUD ARIFIN ACHMAD PEKANBARU

BPJS Kesehatan berlaku efektif pada tanggal 1 Januari 2014. BPJS Kesehatan merupakan suatu badan hukum publik yang menggantikan PT. ASKES (Persero). Seluruh penduduk Indonesia termasuk WNA yang bekerja minimal 6 bulan di Indonesia wajib mendaftarkan diri menjadi peserta BPJS Kesehatan. Demi tercapainya perlindungan kesehatan, maka BPJS Kesehatan melakukan kerjasama dengan berbagai fasilitas kesehatan. RSUD Arifin Achmad Pekanbaru yang memang sudah sejak dahulu bekerjasama dengan PT. ASKES (Persero) hanya tinggal melanjutkan kerjasamanya dengan BPJS Kesehatan. Perjanjian kerjasama tersebut tidak hanya memuat hak dan kewajiban dari BPJS Kesehatan dan RSUD Arifin Achmad Pekanbaru saja. Namun terdapat pula beberapa kewajiban rumah sakit yang harus dilaksanakan demi pasien peserta JKN BPJS Kesehatan. Pada implementasinya, masih banyak terjadi penyimpangan dari ketentuan yang diatur dalam perjanjian kerjasama tersebut. Selain itu, peserta BPJS Kesehatan juga masih sangat kurang pengetahuannya mengenai BPJS Kesehatan. Oleh karena itu, kajian mendalam mengenai perjanjian kerjasama antara BPJS Kesehatan dengan RSUD Arifin Achmad Pekanbaru, khususnya dalam hal perlindungan terhadap pasien peserta JKN BPJS Kesehatan yang berobat di RSUD Arifin Achmad serta bentuk pertanggungjawaban dari rumah sakit apabila pasien mengalami kerugian perlu dilakukan.

BPJS Kesehatan became effective on January 1, 2014. BPJS Kesehatan is a public legal entity that replaces PT. Askes (Persero). The entire population of Indonesia, including foreigners who work at least 6 months in Indonesia is required to register as participants of BPJS Kesehatan. In order to achieve health care, the BPJS Kesehatan makes cooperation with various health facilities. RSUD Arifin Achmad Pekanbaru which had been long ago in cooperation with PT. ASKES (Persero) just continue the cooperation with BPJS Health. The cooperation agreement contains not only the rights and obligations of BPJS Kesehatan and RSUD Arifin Achmad Pekanbaru. But there are also some hospitals obligations that must be implemented for JKN BPJS Kesehatan patients. In the implementation, there are many deviations from the provisions set forth in the partnership agreement. In addition, participants of BPJS Kesehatan also still lack knowledge about BPJS Kesehatan. Therefore, in-depth review of the cooperation agreement between the BPJS Kesehatan with RSUD Arifin Achmad Pekanbaru, particularly in terms of the protection of the patient, who was treated JKN BPJS at Arifin Achmad as well as a form of accountability from the hospital if the patient suffered a loss needs to be done.
