Merespons Dominasi Platform Digital: Intervensi Negara dalam Melindungi Media Konvensional melalui Kebijakan Publisher Rights

Digitalisasi telah mengubah struktur pasar media secara fundamental melalui pergeseran alokasi biaya iklan (Advertising Expenditure atau AdEx) dari media konvensional ke platform digital. Akibatnya, media konvensional mengalami penurunan pendapatan yang begitu drastis dan menghadapi ancaman bagi operasionalnya. Artikel ini menganalisis kemampuan negara dalam melindungi media konvensional dan merespons dominasi platform digital melalui Peraturan Presiden Nomor 32 Tahun 2024 tentang Tanggung Jawab Perusahaan Platform Digital untuk Mendukung Jurnalisme Berkualitas (Publisher Rights), serta melihat dampaknya bagi eksistensi media konvensional saat ini. Penelitian ini menggunakan pendekatan kualitatif dengan metode studi kasus. Temuan penelitian menunjukkan bahwa Publisher Rights lebih berfungsi sebagai symbolic regulation daripada instrumen redistributif yang efektif. Hal ini terecermin dari lemahnya desain kebijakan itu sendiri. Rendahnya kepatuhan platform digital, terbatasnya cakupan regulasi, serta ketiadaan sanksi tegas menunjukkan bahwa negara tidak memiliki daya paksa yang cukup untuk mengatur aktor digital yang dominan. Hasilnya, kebijakan belum mampu memulihkan ketimpangan ekonomi yang muncul sebagai imbas dari pergeseran Advertising Expenditure (AdEx), sementara krisis keberlanjutan media masih terus berlanjut. Artikel ini juga merekomendasikan perlunya penegakan dan perluasan cakupan kebijakan, serta perumusan tata kelola digital yang lebih komprehensif untuk membatasi dominasi platform digital dalam jangka panjang. 

Digitalization has fundamentally changed the structure of the media market through a shift in advertising expenditure (AdEx) from conventional media to digital platforms. As a result, conventional media has experienced a drastic decline in revenue and faces threats to its operations. This article analyzes the state's ability to protect conventional media and respond to the dominance of digital platforms through Presidential Regulation No. 32 of 2024 concerning the Responsibility of Digital Platform Companies to Support Quality Journalism (Publisher Rights), while also examining its impact on the current existence of conventional media. This article used a qualitative approach with a case study method. The findings show that Publisher Rights functions more as a form of symbolic regulation than as an effective redistributive instrument. This is reflected in the weak design of the policy itself. Low levels of digital platform compliance, limited regulatory scope, and the absence of strict sanctions indicate that the state lacks sufficient enforcement capacity to regulate dominant digital actors. As a result, the policy has not yet succeeded in addressing the economic imbalance caused by shifts in advertising expenditure (AdEx), and the crisis of media sustainability persists. This article also recommends strengthening enforcement mechanisms and expanding the scope of the policy, alongside the formulation of a more comprehensive digital governance to curb digital platform dominance in the long term.
