Analisis Hukum Sponsorship Tenaga Kesehatan dalam Permenkes No. 58 Tahun 2016 Berdasarkan Asas Keadilan, Kemanfaatan, dan No Quid Pro Quo

Permenkes 58/2016 mengatur pemberian sponsorship dari industri kesehatan kepada tenaga kesehatan untuk meningkatkan kompetensi dan kualitas layanan. Penelitian ini menilai penerapan asas keadilan dan kemanfaatan dalam Permenkes 58/2016 serta mengkaji adopsi doktrin no quid pro quo sebagai pagar etik guna menjaga independensi tenaga kesehatan agar sponsorship dikelola secara adil, bermanfaat, dan bebas konflik kepentingan.
Penelitian menggunakan metode yuridis normatif melalui telaah peraturan perundang-undangan, asas hukum, doktrin, dan kerangka etik profesi. Analisis sistematis dilakukan untuk menangkap makna keadilan, kemanfaatan, dan prinsip no quid pro quo dalam relasi tenaga kesehatan, institusi, dan industri. Pendekatan ini mengidentifikasi kesenjangan normatif dan ketidaksesuaian antara aturan dan praktik, serta memetakan kebutuhan reformasi agar tata kelola sponsorship selaras dengan profesionalitas dan perlindungan pasien.
Hasil penelitian menunjukkan bahwa Permenkes 58/2016 telah memuat asas keadilan dalam perspektif fair equality of opportunity melalui ketentuan bahwa sponsorship tidak diberikan langsung kepada individu melainkan disalurkan melalui institusi, meskipun belum tersedia mekanisme yang menjamin kesetaraan kesempatan untuk memperoleh sponsorship. Asas keadilan distributif belum terpenuhi karena ketiadaan batas wajar nilai sponsorship, sementara asas keadilan korektif belum terwujud akibat tidak adanya mekanisme sanksi bagi institusi maupun industri. Asas kemanfaatan tercermin dalam pandangan utilitarian Bentham, namun manfaat sponsorship masih berfokus pada individu dan belum memperkuat sistem pelayanan kesehatan secara lebih luas. Prinsip no quid pro quo telah diadopsi secara normatif, tetapi belum ditopang oleh kerangka tata kelola konflik kepentingan yang komprehensif sebagaimana diatur dalam PP 28/2024, Permenkes 24/2019, UU Administrasi Pemerintahan, dan UU Tipikor. Oleh karena itu, penyempurnaan Permenkes 58/2016 diperlukan untuk menjamin keadilan akses sponsorship, meningkatkan kemanfaatan publik, dan mencegah konflik kepentingan secara sistemik.
Minister of Health Regulation No. 58 of 2016 (Permenkes 58/2016) governs the provision of sponsorship from the health industry to healthcare professionals with the aim of enhancing professional competence and the quality of health services. This study examines the application of the principles of justice and utility in Permenkes 58/2016 and analyzes the extent to which the doctrine of no quid pro quo is adopted as an ethical safeguard to preserve the independence of healthcare professionals, ensuring that sponsorship is managed fairly, beneficially, and free from conflicts of interest.
Using a normative juridical method, this research examines legislation, legal principles, doctrines, and relevant professional ethical standards. The analysis systematically interprets justice, utility, and no quid pro quo within the relationship between healthcare professionals, institutions, and industry sponsors, allowing the identification of regulatory gaps, misalignments between norms and practice, and the need for reform to better align sponsorship governance with professional ethics and patient protection.
The findings show that Permenkes 58/2016 reflects Rawls’s principle of fair equality of opportunity by requiring sponsorship to be channeled through institutions rather than directly to individuals. However, the absence of transparent access mechanisms, reasonable limits on sponsorship value, and sanctions for institutions and industry actors indicates shortcomings in distributive and corrective justice. From a utilitarian perspective, sponsorship contributes to individual competency development but has not yet generated broader systemic benefits for the health system. Although the no quid pro quo principle is normatively recognized, it is not supported by a comprehensive conflict-of-interest governance framework. Therefore, regulatory refinement is necessary to ensure equitable access, enhance public utility, and strengthen the prevention of conflicts of interest.
