Implementasi Asas Efektivitas Pemerintahan Dalam Pemanfaatan Tanah Kalurahan Untuk Kepentingan Sosial di Kalurahan Wonokerto Kapanewon Turi

Penelitian ini memiliki dua tujuan, pertama, untuk mengetahui dan menganalisis implementasi asas efektivitas pemerintahan dalam pelaksanaan pemanfaatan tanah kalurahan. Kedua, mengetahui dan menganalisis kendala atau hambatan dalam implementasi asas efektivitas pemerintahan dalam pemanfaatan tanah kalurahan di Kalurahan Wonokerto Kecamatan Turi.       

Jenis penelitian yang digunakan adalah yuridis empiris yang bersifat deskriptif. Penelitian diawali dengan mengkaji peraturang perundang – undangan terkait dan permasalahan yang diperoleh dari studi lapangan melalui wawancara. Subjek wawancara terdiri dari 6 (enam) responden dan 1 (satu) narasumber. Setelah data diperoleh maka dikumpulkan serta dianalisis menggunakan metode kualitiatif.

Peraturan Gubernur Daerah Istimewa Yogyakarta Nomor 24 Tahun 2024 tentang Pemanfaatan Tanah Kalurahan mengatur mengenai Tanah Kalurahan yang merupakan bagian dari Tanah Kasultanan dan Kadipaten yang dimanfaatkan untuk tujuan kepentingan sosial dan pedoman pemanfaatannya didasarkan pada beberapa asas yang salah satunya yaitu asas efektivitas pemerintahan. Meskipun dalam pemanfaatannya sudah digunakan sesuai fungsinya, namun implementasi asas tersebut belum sepenuhnya sesuai karena tanah yang digunakan belum terbit izin dari Kasultanan atau Kadipaten dikarenakan lambatnya proses administrasi berupa revisi dalam melengkapi berkas oleh pemohon atau Pemerintah Kalurahan. Sampai saat ini belum ada teguran langsung yang diberikan guna mempercepat proses izinnya, namun Dinas Pertanahan dan Tata Ruang ditingkat Kabupaten sudah melakukan pengawasan yang dimulai sejak tahun 2023 yaitu menjadi fasilitator dengan melakukan sosialisasi terhadap Kalurahan yang ada di Kabupaten Sleman agar segera memulai permohonan izin dengan terlebih dahulu mengkonsultasikan dokumen permohonan guna mengoptimalkan proses pemanfaatan Tanah Kalurahan.

This study has two objectives, first, to determine and analyze the implementation of the principle of government effectiveness in the implementation of village land utilization. Second, to determine and analyze the obstacles or barriers in the implementation of the principle of government effectiveness in the utilization of village land in Wonokerto Village, Turi District.

 The type of research used is empirical juridical which is descriptive in nature. The research begins by reviewing related laws and regulations and problems obtained from field studies through interviews. The interview subjects consisted of 6 (six) respondents and 1 (one) informant. After the data is obtained, it will be collected and analyzed using qualitative methods. 

Regulation of the Governor of the Special Region of Yogyakarta Number 24 of 2024 concerning the Use of Village Land regulates Village Land which is part of the Sultanate and Duchy Land which is used for social purposes and guidelines for its use are based on several principles, one of which is the principle of government effectiveness. Even though the utilization has been used according to its function, the implementation of this principle is not yet fully appropriate because the land used has not been issued a permit from the Sultanate or Duchy due to the slow administrative process in the form of revisions in completing the documents by the applicant or the District Government. Until now, there has been no direct warning given to speed up the permit process, however, the Land and Spatial Planning Service at the Regency level has carried out supervision starting in 2023, namely becoming a facilitator by conducting outreach to sub-districts in Sleman Regency so that they can immediately start permit applications by first consulting the application documents in order to optimize the process of utilizing sub-district land.
