POTENSI PELANGGARAN DAN UPAYA PENYELESAIAN SENGKETA INDIKASI GEOGRAFIS DI INDONESIA (STUDI KASUS PERKARA NO. 78/PDT.SUS-HKI/MEREK/2021/PN NIAGA JKT.PST ANTARA THE SCOTCH WHISKY ASSOCIATION MELAWAN PT. INDUSTRI SEMAK)

Penelitian ini bertujuan untuk mengkaji pengaturan terkait potensi pelanggaran hukum terhadap Indikasi Geografis “Scotch Whisky” milik The Scotch Whisky Association dan implikasi hukum yang terjadi setelah Pengadilan Niaga Jakarta Pusat menjatuhkan Putusan terhadap Sengketa Indikasi Geografis antara The Scotch Whisky Association melawan PT Industri Semak pada Perkara No. 78/Pdt.Sus-HKI/Merek/2021/PN Niaga Jkt.Pst di Pengadilan Niaga pada Pengadilan Negeri Jakarta Pusat. 

Penelitian hukum ini berjenis penelitian hukum normatif atau kepustakaan karena bahan pustaka menjadi data dasar yang dalam penelitian digolongkan sebagai data sekunder. Penelitian hukum ini bersifat deskriptif, karena di dalamnya dipaparkan dasar pemikiran potensi pelanggaran Indikasi Geografis dan upaya penyelesaian sengketa Indikasi Geografis guna mendapat uraian lengkap tentang hal tersebut. Penelitian ini menggunakan metode analisis kualitatif dengan wawancara atau interview narasumber yang kemudian hasil wawancara tersebut diolah guna mendapatkan gambaran yang jelas terhadap masalah yang diteliti penulis.

Hasil Penelitian menyimpulkan bahwa putusan Judex Factie pada Perkara No. 78/Pdt.Sus-HKI/Merek/2021/PN Niaga Jkt.Pst di Pengadilan Niaga pada Pengadilan Negeri Jakarta Pusat tidak memuat beberapa pertimbangan yang menurut Penulis diperlukan sebagai preseden kasus-kasus serupa yang dapat terjadi di kemudian hari, sebelum mencapai konklusi tidak terdapatnya pelanggaran indikasi geografis yang dilakukan oleh PT Industri Semak dengan produk Glen Classic terhadap The Scotch Whisky Association karena PT Industri Semak sebagai Tergugat telah berhenti memproduksi dan menjual produk Glen Classic sebelum Scotch Whisky dilindungi sebagai Indikasi Geografis terdaftar di Indonesia sehingga tidak ada akibat hukum apapun terhadap PT Industri Semak.

This research aims to examine regulations related to potential legal violations of the Geographical Indication "Scotch Whiskey" belonging to The Scotch Whiskey Association and the legal implications that occurred after the Central Jakarta Commercial Court decision regarding the Geographical Indication Dispute between The Scotch Whiskey Association and PT Industri Semak in Case No. 78/Pdt.Sus-HKI/Merek/2021/PN Niaga Jkt.Pst at the Commercial Court at the Central Jakarta District Court.

This legal research is of the normative legal research or literature type as library materials are basic data which in research is classified as secondary data. This legal research is descriptive in nature, because it explains the rationale for potential violations of Geographical Indications and efforts to resolve Geographical Indication disputes in order to obtain a complete description of this matter. This research uses a qualitative analysis method with pracitioner interviews whereas the interview materials are processed to get a clear picture of the problem studied by the Author.

The research results concluded that the Judex Factie decision in Case No. 78/Pdt.Sus-HKI/Merek/2021/PN Niaga Jkt.Pst in the Commercial Court at the Central Jakarta District Court does not contain several considerations which according to the author are needed as a precedent for similar cases that could occur in the future, before reaching a conclusion that there was no geographical indications violation committed by PT Industri Semak with  their Glen Classic products against The Scotch Whiskey Association because PT Industri Semak as the Defendant had stopped producing and selling Glen Classic products before Scotch Whiskey was protected as a registered Geographical Indication in Indonesia so there were no legal consequences whatsoever against PT Semak Industries.
