Pelaksanaan Undang-Undang Nomor 28 Tahun 2014 Tentang Hak Cipta Terkait Kegiatan Penggandaan Buku Oleh Jasa Fotokopi Di Kota Kendari

Tujuan dari penelitian ini adalah untuk menganalisis praktik penggandaan buku oleh jasa fotokopi di Kota Kendari ditinjau berdasarkan undang-undang hak cipta. Selain itu, penelitian ini juga bertujuan untuk menemukan hambatan-hambatan yang terjadi dalam penegakan hukum Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta terkait kegiatan penggandaan buku oleh jasa fotokopi di Kota Kendari. Penelitian ini berjenis yuridis-empiris dan bersifat deskriptif. Data dalam penelitian ini diperoleh melalui penelitian kepustakaan dan penelitian lapangan. Penelitian lapangan dilakukan melalui wawancara dengan responden dan narasumber. Data-data yang diperoleh dianalisis dengan menggunakan metode kualitatif yang kemudian disajikan secara deskriptif sehingga dapat menggambarkan keadaan yang sebenarnya terjadi di lapangan guna menjawab rumusan-rumusan masalah dalam penelitian. Berdasarkan hasil penelitian, diperoleh fakta bahwa bahwa praktik penggandaan buku oleh jasa fotokopi di Kota Kendari belum sejalan dengan ketentuan dalam Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta. Terdapat hambatan-hambatan dalam penegakan hukum Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta terkait penggandaan buku oleh jasa fotokopi di Kota Kendari yaitu (1) pelaku usaha fotokopi tidak mengetahui regulasi pelindungan terhadap hak atas kekayaan intelektual khususnya karya cipta buku karena tidak pernah menerima sosialisasi baik dari pemerintah maupun penerbit, dan (2) praktik komersialisasi tanpa izin dan pembajakan buku fotokopian oleh jasa fotokopi disebabkan oleh adanya kebutuhan dan permintaan pelanggan terhadap buku-buku pelajaran karena tidak tercukupinya ketersediaan buku di sekolah-sekolah.

The purpose of this study is to analize the practice of copying books by photocopying services in Kendari City in terms of copyright law. In addition, this study also aims to find the obstacles that occur in law enforcement of Law Number 28 of 2014 concerning Copyright related to book duplication activities by photocopying services in Kendari City. This research is juridical-empirical type and descriptive in nature. The data in tis study were obtained through library researcg and field research. Field research was conducted through interviews with respondents and sources. The data obtained is analyzed using a qualitative method which is then presented descriptively so that it can describe the actual situation in the field in order to answer the formulations of the problems in the study. Based on the result of the research, it is found that the practice of copying books by photocopying services in Kendari City has not been in line with the provisions in Law Number 28 of 2014 concerning Copyright. There are obstacles in law enforcement of Law Number 28 of 2014 concerning Copyright related to the duplication of books by photocopying services in Kendari City, namely (1) photocopying business actors do not know the regulations on the protection of intellectual property rights, especially copyrighted works of books because they have never received socialization from both the government and publishers, and (2) the practice of unautorized commercialization and piracy of photocopied books by photocopying services is caused by the nedd and demand of customers for textbooks due to insuffient availability of books in schools
