IMPLIKASI HUKUM TERHADAP PERUBAHAN KEWAJIBAN NOTARIS SEBAGAI PEJABAT LELANG KELAS II DALAM PELAKSANAAN LELANG DENGAN KEHADIRAN PESERTA DAN LELANG TANPA KEHADIRAN PESERTA DI DAERAH ISTIMEWA YOGYAKARTA

Penelitian ini bertujuan untuk mengetahui dan menganalisis perbedaan kewajiban hukum Notaris sebagai Pejabat Lelang Kelas II terhadap pelaksanaan lelang dengan kehadiran peserta dan lelang tanpa kehadiran peserta, serta untuk mengetahui implikasi hukum terhadap perubahan kewajiban tersebut.

Penelitian ini merupakan penelitian normatif empiris dengan melakukan penelitian wawancara dan studi hukum kepustakaan berupa data primer dan data sekunder. Teknik pengumpulan data yang digunakan adalah metode wawancara kepada narasumber yang merupakan Notaris sebagai Pejabat Lelang Kelas II di Daerah Istimewa Yogyakarta dan studi kepustakaan dari literatur yang terkait dengan objek penelitian pendekatan perundang-undangan. Hasil analisis akan diuraikan secara deskriptif kualitatif.

Berdasarkan hasil penelitian dapat disimpulkan bahwa kewajiban yang dijalankan oleh Pejabat Lelang Kelas II antara pelaksanaan lelang dengan kehadiran peserta dan lelang tanpa kehadiran peserta adalah sama, hanya saja terdapat beberarapa perubahan secara teknis atas kewajiban Pejabat Lelang Kelas II pada kedua pelaksanaan lelang tersebut seperti pengecekan dokumen. Selanjutnya, atas perubahan kewajiban Notaris sebagai Pejabat Lelang Kelas II dalam pelaksanaan lelang dengan kehadiran peserta dan lelang tanpa kehadiran peserta di Daerah Istimewa Yogyakarta belum ditemukan kasus yang merugikan bagi peserta lelang, yang peneliti temukan adalah adanya proses yang lebih memudahkan akibat adanya perubahan kewajiban ini. Kemudian atas perubahan kewajiban Notaris sebagai Pejabat Lelang Kelas II tersebut bahwa Jabatan Notaris dan Pejabat Lelang Kelas II tidak melekat satu sama lain. Keduanya berada dibawah Kementrian yang berbeda dengan tugas pokok dan fungsi yang berbeda akan tetapi secara aturan diperbolehkan apabila Notaris merangkap jabatan sebagai Pejabat Lelang Kelas II.

This study aims to know and analyze the differences in legal obligations of Notary as Class II Auction Officer for the conduct of auctions with the attendance of participants and auctions without the attendance of participants, as well as to know the legal implications for the changes in such obligations.

This research is an empirical normative research by conducting interview research and library legal studies in the form of primary data and secondary data. The data collection technique used is the method of interviewing to the source who is a Notary as a Class II Auction Officer in Yogyakarta Special Region and the study of the literature related to the object of the legislation approach research. The analysis results will be described descriptively qualitatively.

Based on the results of the study can be concluded that the obligations undertaken by Class II Auction Officer between the conduct of auction with the attendance of the participants and the auction without the attendance of the participant are the same, only that there are technically changes to the obligations of Class II Auction Officer on both conducting the auction such as document checking. Furthermore, on the change of Notary obligations as Class II Auction Officer in the conduct of auctions with the attendance of participants and auctions without the presence of participants in Yogyakarta Special Region has not found any adverse cases for the auction participants, which the authors found is a process that is more facilitating due to changes in this obligation. Then upon the change of Notary obligations as Class II Auction Officer that the Notary Department and Class II Auction Officer are not attached to each other. Both are under different Ministry with different principal duties and functions but are legally allowed if the Notary is to assume office as Class II Auction Officer.
