Potensi Eksploitasi Kurir Oleh Shopee Xpress Dalam Hubungan Kemitraan Ditinjau Dari Prinsip Keadilan Etika Bisnis

Permasalahan yang diangkat dalam penelitian ini dilatarbelakangi oleh hubungan kemitraan pada sistem ekonomi gig yang diterapkan dalam hubungan antara kurir dengan Shopee Xpress. Hal ini berhubungan dengan kerentanan yang ada pada sistem ekonomi gig.  Tujuan dari penelitian tersebut adalah menjelaskan mengenai prinsip keadilan etika bisnis, menjelaskan mengenai sistem hubungan kemitraan antara kurir dengan Shopee Xpress dan memberikan deskripsi mengenai potensi eksploitasi terhadap pihak kurir oleh Shopee Xpress dalam hubungan kemitraan dalam prinsip keadilan etika bisnis.

Kajian ini merupakan kajian kualitatif dengan menggunakan fenomena  aktual. Metode yang digunakan adalah metode hermeneutika filosofis dengan  tahap pengumpulan data berupa inventarisasi informasi, klasifikasi, analisis-sintesis dan penyusunan hasil. Lalu, tahap analisis hasil berupa deskripsi, interpretasi, analisis hermeneutis dan refleksi kritis. Data-data diperoleh berdasarkan studi kepustakaan. Objek material penelitian adalah potensi eksploitasi kurir oleh Shopee Xpress dalam hubungan kemitraan, sedangkan objek formal dalam penelitian ini adalah prinsip keadilan etika bisnis. 

Hasil dari penelitian ini pertama, implementasi prinsip keadilan dalam kegiatan bisnis dapat meminimalisir tindakan yang mengabaikan hak dan kepentingan setiap pihak yang terlibat. Kedua, hubungan kemitraan yang terjalin antara pihak Shopee Xpress menimbulkan ketidakjelasan mengenai jam kerja, beban kerja, upah, jaminan dan payung hukum bagi pihak kurir selaku mitra. Hal ini akan membawa mitra pada kerentanan. Ketiga, kerentanan yang dirasakan oleh pihak kurir membawa pada kurir pada potensi eksploitasi. Kerentanan tersebut karena adanya ketidakjelasan jam kerja, beban, upah, jaminan dan payung hukum. Terlebih, pada hubungan tersebut tidak adanya negosiasi. Hak-hak dan kepentingan kurir bergantung pada kebijakan yang diputuskan oleh pihak perusahaan. Nilai etis dan adil dalam hubungan kemitraan akan bergantung kepada setiap keputusan yang dikeluarkan Shopee Xpress selaku pemilik modal. 

The issues addressed in this research are motivated by the partnership within the gig economy system implemented between Shopee Xpress and its couriers. This is related to the vulnerabilities present within the gig economy system. The objective of this research is to explain the principles of justice in business ethics, describe the partnership system between Shopee Xpress and its couriers, and provide a description of the potential exploitation of couriers by Shopee Xpress under the partnership through the principles of justice in business ethics.

This study is a qualitative study regarding an actual phenomenon. The method used is the philosophical hermeneutic method, with data collection stages consisting of information inventory, classification, analysis-synthesis, and result compilation. The analysis of the results includes description, interpretation, hermeneutic analysis, and critical reflection. The data are obtained through literature review. The material object of the research is the potential exploitation of couriers by Shopee Xpress in the partnership relationship, while the formal object in this study is the principle of fairness in business ethics.

The results of this research are as follows: firstly, the implementation of justice principles in business activities can minimize actions that neglect the rights and interests of all parties involved. Secondly, the partnership between Shopee Xpress and its couriers leads to ambiguity regarding working hours, workload, wages, guarantees, and legal protection for couriers as partners. This exposes partners to vulnerabilities. Thirdly, the perceived vulnerability of couriers leads to the potential for exploitation. This vulnerability arises due to the lack of clarity in working hours, workload, wages, guarantees, and legal protection. Furthermore, negotiation is absent within the relationship. The rights and interests of couriers depend on the policies decided by the company. Ethical and fair values in the partnership will depend on the decisions made by Shopee Xpress as the capital owner.
