Praktik Illegal Scanlation terhadap Komik Digital pada Platform WEBTOON ditinjau dari Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta

Penelitian hukum yang telah dilakukan terkait hukum hak kekayaan intelektual ini memiliki tujuan untuk mengetahui dan menganalisis pelindungan hak cipta atas komik digital pada platform WEBTOON terhadap praktik illegal scanlation ditinjau dari Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta (UU 28/2014). Selain itu, penelitian ini juga bertujuan untuk mengetahui dan menganalisis terkait proses penyelesaian sengketa hak cipta pada praktik illegal scanlation terhadap komik digital pada platform WEBTOON.

Penulis melakukan penelitian hukum kualitatif dengan metode penelitian hukum yuridis normatif yang didukung dengan data yuridis empiris. Penelitian yuridis normatif dilakukan melalui penelitian kepustakaan yang digunakan untuk mendapatkan data sekunder. Data sekunder pada penelitian yuridis normatif diperoleh dengan menganalisis bahan hukum primer, bahan hukum sekunder, dan bahan hukum tersier. Sedangkan, penelitian yuridis empiris dilakukan dengan melakukan wawancara terhadap responden untuk memperoleh data primer. Responden diperoleh dengan menggunakan teknik purposive sampling yang terdiri dari kreator komik digital pada platform WEBTOON, former illegal scanlator, dan pembaca illegal scanlation. 

Hasil penelitian hukum yang telah dilakukan menunjukkan bahwa: Pertama, pelindungan hak cipta atas komik digital terhadap praktik illegal scanlation pada platform WEBTOON dilindungi melalui pelindungan hak eksklusif yang berupa hak moral dan hak ekonomi. UU 28/2014 menjamin hak eksklusif kreator komik digital sebagai pencipta dan pemegang hak, serta WEBTOON sebagai penerima lisensi. Kedua, upaya hukum yang dapat dilakukan pada praktik illegal scanlation terhadap komik digital pada platform WEBTOON dapat dilakukan dengan upaya non-litigasi dan litigasi. Upaya yang dapat dilakukan dalam menyelesaikan permasalahan terkait praktik illegal scanlation dapat dilakukan sesuai dengan prosedur pada ketentuan WEBTOON ataupun hukum positif tentang hak cipta yang berlaku dalam yurisdiksi hukum penyelesaian sengketa. 

The legal research conducted regarding intellectual property law has the objective of knowing and analyzing copyright protection for digital comics on the WEBTOON platform against illegal scanlation practices according to Law Number 28 of 2014 concerning Copyright (Law 28/2014). In addition, this study also aims to identify and analyze the process of resolving intellectual property rights disputes in the illegal scanlation practice of digital comics on the WEBTOON platform.

The author conducted qualitative legal research using normative juridical legal research methods supported by empirical data. The normative juridical research was carried out through library research to obtain secondary data. Secondary data is obtained by analyzing primary legal materials, secondary legal materials, and tertiary legal materials. Meanwhile, empirical research is conducted by interviewing the respondents to obtain primary data. Respondents were obtained using a purposive sampling technique consisting of digital comic creators on the WEBTOON platform, former illegal scanlators, and illegal scanlation readers.

The results of the legal research that has been carried out show that: First, the copyrights protection over digital comics against illegal scanlation practices on the WEBTOON platform is protected through the protection of exclusive rights in the form of moral rights and economic rights. Law 28/2014 guarantees the exclusive rights of digital comic creators as creators and rights holders, as well as WEBTOON as licensees. Second, legal remedies that can be taken against the practice of illegal scanlation of digital comics on the WEBTOON platform can be carried out through non-litigation and litigation efforts. Efforts that can be made to resolve problems related to illegal scanlation practices can be carried out following the procedures in WEBTOON provisions or the positive law regarding copyright that applies in the jurisdiction of dispute resolution law.
