Pelindungan Hukum Terhadap Pembuat Konten Stand-Up Comedy atas Tindakan Re-Uploader pada Platform Video Youtube Ditinjau dari UU Nomor 28 Tahun 2014 tentang Hak Cipta

Untuk mengetahui apa serta bagaimana dan menganalisa Pelindungan hukum yang dijaminkan oleh UU Nomor 28 Tahun 2014 tentang Hak Cipta untuk pembuat konten Stand-Up Comedy atas tindakan reuploader pada platform video Youtube. Riset ini terklasifikasi dalam penelitian normatif empiris yang sifatnya deskriptif. Telaah normatif dilakukan melalui penelitian kepustakaan untuk memperoleh data sekunder lewat telaah dokumen. Riset empiris dikerjakan melalui investigasi lapangan guna memperoleh data pokok dengan teknik interviu. Data hasil penelitian dianalisis secara kualitatif. Temuan dan bahasan riset menemukan beberapa hal. Pertama, bahan Stand-up comedy maupun konten stand-up comedy merupakan suatu hasil karya yang memenuhi konsep karya cipta berlandaskan Undang-Undang Hak Cipta sehingga karya-karya yang diciptakan perlu dan wajib mendapat pelindungan hukum hak cipta maka, para pelaku stand-up comedy dan juga pembuat asli konten stand-up comedy harus mendapatkan pelindungan sebagai pelaku pertunjukan. Kedua, Terdapat dua macam pelindungan hukum yakni lewat jalur preventif dan represif. Usaha preventif dapat dilaksanakan dengan penerbitan peraturan perundang-undangan. Peraturan yang dimaksud ialah UU No. 11 tahun 2008 tentang Informasi dan Transaksi Elektronik. Pelindungan hukum secara represif dapat diterapkan melalui metode litigasi ataupun non-litigasi.

This research aims to determine and find out what and how and to analyze the legal protection provided by Law Number 28 of 2014 about Copyrights for Stand-Up Comedy content creators against re-uploader actions on Youtube. This research is descriptive, empirical juridical research. Juridical research is carried out through library research to obtain secondary data by means of document studies. Empirical research is carried out through field research to obtain primary data by means of interviews. The data analysis in this research was conducted qualitative. The results of the research and discussion showed that first, Stand-up comedy material, and stand-up comedy content is a work that meets the concept of work based on the Copyright Act. Thus, works that need and must be protected by copyright law. So, stand-up comedy actors and also original stand-up comedy content creators must get protection as performers. Second, there are two kinds of legal protection, namely preventive and repressive. Preventive protection can be carried out through the issuance of laws and regulations. The laws and regulations governing copyright protection are regulated in Law Number 28 of 2014 concerning Copyright and Law Number 11 of 2008 concerning Information and Electronic Transactions. Repressive legal protection can be carried out through non-litigation and litigation.
