Hambatan dan Tantangan Penetapan Rancangan Undang-Undang tentang Perlindungan Pekerja Rumah Tangga

Rancangan Undang Undang Perlindungan Pekerja Rumah Tangga (selanjutnya ditulis RUU Perlindungan PRT) merupakan RUU yang telah disusun sejak 2004 dan bertujuan untuk memberi perlindungan hukum dan hak-hak bagi PRT di Indonesia. Meski terdapat setidaknya 4,2 juta warga negara Indonesia yang berprofesi sebagai PRT (ILO, 2015), hingga saat ini masih belum terdapat kerangka regulasi yang dapat memberikan perlindungan hukum secara substansial untuk profesi yang rentan akan kekerasan dan diskriminasi ini. Lambannya proses pengesahan RUU Perlindungan PRT adalah persoalan yang menjadi fokus dari penelitian ini. Penelitian ini merupakan penelitian kualitatif yang didukung dengan data-data sekunder yakni dokumen dan arsip digital serta melibatkan 2 narasumber yakni dari JALA PRT dan Kantor Staf Presiden. Dalam menganalisis proses legislasi RUU Perlindungan PRT, penelitian ini menggunakan multiple stream frameworks oleh Kingdon serta political will oleh Post et al. Analisis dari ketiga aliran multiple stream frameworks diperlukan untuk mengetahui potensi bottleneck dalam proses legislasi RUU Perlindungan PRT. Sedangkan teori political will digunakan untuk melengkapi aliran ketiga dari multiple stream frameworks yakni aliran politik. Temuan dari penelitian ini adalah bahwa belum terbentuk public pressure serta kesepahaman antara para pengambil keputusan terkait perlunya sebuah kebijakan solutif mengenai persoalan PRT. Keberagaman interpretasi dan persepsi ini menjadi penghambat perwujudan RUU Perlindungan PRT.

ABSTRACT The Draft Bill on Domestic Workers' Protection has been drafted since 2004 with the aim of providing legal protection and rights for domestic workers in Indonesia. Despite the fact that there are at least 4.2 million Indonesian citizens who work as domestic workers (ILO, 2015), there is still no regulatory framework that can provide substantial legal protection for this vulnerable profession, which is prone to violence and discrimination. The slow process of enacting the Draft Bill on Domestic Workers' Protection is the focus of this research. This is a qualitative study that is supported by secondary data such as digital documents and archives, and involves 2 informants from JALA PRT and the Executive Office of the President of the Republic of Indonesia. In analyzing the legislative process of the Draft Bill on Domestic Workers' Protection, this study uses the theory of political will by Post et al. Analysis of the components of political will is necessary to determine the strength of the political will of decision-makers and to identify potential bottlenecks that cause delays in providing protection for domestic workers. The findings of this study indicate that there is no consensus among decision-makers regarding the need for a solutive policy on domestic workers' issues. This diversity of interpretations and perceptions has become a barrier to the enactment of the Draft Law on Domestic Workers' Protection.
