The Politics of Halal Certification : Implementasi Kebijakan Sertifikasi Halal di Indonesia Periode 2019-2020

Undang Undang Nomor 33 Tahun 2014 tentang Jaminan Produk Halal memindahkan kewenangan dari MUI ke BPJPH dan mengubah sifat dari voluntary menjadi mandatory. Implementasi kebijakan tersebut mulai dilaksanakan pada Oktober 2019. Penelitian ini melihat kebijakan sertifikasi halal dari sisi implementasinya menggunakan metode kualitatif. Sumber data didapatkan dari in depth interview dan literatur terkait. Pembahasan akan berfokus pada policy content, policy context, dan policy outcomes. Hingga satu tahun diterapkan, turunan kebijakan sertifikasi halal belum juga disahkan. Salah satu faktornya adalah disahkannya UU Cipta Kerja yang merubah isi dari UU JPH. Proses implementasi yang dilakukan secara multiaktor juga turut menghambat implementasi karena belum adanya kesepakatan antar aktor. Implementasi kebijakan sertifikasi halal periode 2019-2020 masih belum maksimal. Berbagai kebingungan terjadi di tubuh implementor maupun masyarakat. Hal tersebut dipengaruhi oleh policy content dan policy context. Implementasi kebijakan tersebut memunculkan policy outcomes yang dapat digunakan untuk evaluasi.

Law Number 33 of 2014 regarding Halal Product Assurance transfers authority from MUI to BPJPH and changes its nature from voluntary to mandatory. The implementation of the policy began in October 2019. This study looks at the halal certification policy in terms of its implementation using qualitative methods. Sources of data obtained from in-depth interviews and related literature. The discussion will focus on policy content, policy context, and policy outcomes. Until one year after the implementation, the derivative of the halal certification policy has not been ratified. One of the factors is the passing of the Job Creation Law which changes the contents of the JPH Law. The multi-actor implementation process also hinders implementation because there is no agreement between actors. The implementation of the halal certification policy for the 2019-2020 period is still not optimal. Various confusion occurred in the body of the implementer and the community. It is influenced by policy content and policy context. The implementation of these policies raises policy outcomes that can be used for evaluation.
