TINJAUAN YURIDIS ATAS TINDAKAN PT TELEKOMUNIKASI INDONESIA (PT TELKOM) TERHADAP LAYANAN VIDEO ON DEMAND DI INDONESIA DITINJAU DARI UNDANG-UNDANG NOMOR 5 TAHUN 1999 TENTANG LARANGAN PRAKTEK MONOPOLI DAN PERSAINGAN USAHA TIDAK SEHAT

Penelitian dalam Penulisan Hukum ini bertujuan untuk mengetahui dan menganalisis tindakan pemblokiran dari PT Telkom Indonesia terhadap Netflix dan tindakan bundling yang dilakukan oleh PT Telkomsel yang diduga sebagai indikasi tindakan persaingan usaha tidak sehat. Selain itu, penelitian ini juga bertujuan untuk mengkaji latar belakang KPPU dalam menindaklanjuti penyelidikan suatu perkara ke tahap yang lebih tinggi. Penelitian ini menggunakan metode penelitian hukum normatif. Penelitian normatif dilakukan dengan mengkaji data kepustakaan dan didukung dengan hasil wawancara dengan narasumber yang relevan. Penelitian berfokus pada analisis hukum positif, asas-asas dan doktrin hukum, serta fenomena yang terjadi di masyarakat. Data yang ada kemudian dianalisis menggunakan metode kualitatif. Berdasarkan hasil penelitian, disimpulkan bahwa tindakan PT Telkom dalam memblokir akses Netflix dapat ditengarai merupakan tindakan yang melanggar Pasal 19 Undang-Undang Nomor 5 Tahun 1999 apabila ditinjau dari unsur-unsur pasal yang bersangkutan namun membutuhkan pembuktian dan pemeriksaan lebih lanjut oleh KPPU untuk menentukan ada tidaknya pelanggaran terhadap pasal tersebut. Tindakan penjualan paket kuota data internet yang dijual secara bundling tidak memenuhi unsur dari tindakan tying agreement yaitu tidak ditemukannya perbedaan karakteristik yang signifikan antara tying product dengan tied product dan tidak adanya syarat perdagangan yang diberikan oleh PT Telkom. Latar belakang KPPU dalam menindaklanjuti penyelidikan suatu perkara ke tahap yang lebih tinggi dalam kasus ini salah satunya disebabkan oleh penelitian oleh KPPU terhadap tingkat kemudahan konsumen untuk bepindah ke penyedia jasa internet lain sehubungan dengan adanya pemblokiran oleh PT Telkom.

The purpose of this research is to find out and analyze the actions of PT Telkom that blocked Netflix access for its consumer and the sale of internet data packages tied to the sale of data packages of video on demand services that have collaborated with PT Telkom, together as an alleged unfair competition action. In addition, this research also aims to examine the background of KPPU in following up on a case investigation into a higher level of examination. This research uses the normative legal research method. Normative research is carried out by reviewing library data and supported by interviews with relevant informants. Research focuses on the analysis of positive law, principles and doctrines of law, as well as phenomena that occur in society. Existing data are then analyzed using qualitative methods. Based on the results of the study, it was concluded that PT Telkom's actions in blocking Netflix access could be suspected as an act that violates Article 19 of Act Number 5 of 1999 when viewed from the elements of the relevant article but requires further proof and examination by KPPU to determine whether there is indeed a violation of the article. The act of selling internet data quota packages sold in bundling does not meet the elements of the tying agreement because there are no significant differences in characteristics between tying products and tied products and there are no trade conditions provided by PT Telkom. One of the factors that determine wheter a case is developed into a higher stage of investigation in this case is a research conducted by KPPU on the level of convenience of consumers to move to other internet service providers in connection with the blocking by PT Telkom of Netflix access.
