PERLINDUNGAN HUKUM TERHADAP UPAH DAN JAM KERJA BAGI PEKERJA DENGAN SISTEM PERJANJIAN KERJA WAKTU TERTENTU (PKWT) DI PT IK

Tujuan penelitian ini yaitu (1) Untuk mengetahui dan mengkaji terkait perlindungan hukum terhadap upah dan jam kerja bagi pekerja dengan sistem Perjanjian Kerja Waktu tertentu (PKWT) Di PT IK (2) Untuk mengetahui dan mengkaji upaya perlindungan hukum yang diberikan oleh Disnaker Kota Madiun terhadap pekerja PKWT di PT PT IK. Penelitian ini merupakan penelitian hukum normatif yang didukung wawancara narasumber. Penelitian hukum normatif dilakukan dengan penelitian kepustakaan dengan menelusuri data sekunder berupa bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier, dengan metode dokumentasi dan alat berupa studi dokumen. Wawancara dilakukan terhadap narasumber dengan menggunakan alat berupa pedoman wawancara. Analisis data menggunakan analisis kualitatif. Berdasarkan hasil penelitian dan pembahasan perlindungan hukum terhadap upah dan jam kerja bagi pekerja PKWT di PT PT IK diketahui jika perlindungan hukum yang sudah diterapkan perusahaan terhadap pekerja PKWT mencakup beberapa aspek yaitu; 1)perlindungan hukum upah, 2) perlindungan hukum terkait berserikat para pekerja 3)perlindungan hukum bagi pegawai khusus perempuan, 4) perlindungan hukum terkait jam kerja dan 5) Perlindungan hukum terkait kesehatan dan keselamatan kerja. Kesimpulan dari Penelitian dan pembahasan tersebut adalah: 1)Perlindungan hukum bagi Pekerja dengan sistem PKWT di PT PT IK belum sepenuhnya terlindungi karena masih ditemukan adanya pelanggaran berupa upah lembur flat yang diterapkan oleh perusahaan tersebut dan jam kerja yang tidak sesuai peraturan perundang-undangan yang berlaku; 2) Upaya yang dilakukan oleh Kantor Disnaker Kota Madiun terhadap perlindungan hukum para pekerja PKWT di PT IK adalah dengan melakukan pembinaan dan pengawasan kepada para pegawai di PT IK; Oleh karena itu disarankan PT IK diharapkan lebih maksimal dalam memberikan perlindungan hukum terkait upah dan jam kerja terhadap para pekerja PKWT di perusahaan tersebut;Kantor Disnaker Kota Madiun diharapkan juga lebih massive dan teratur lagi dalam memberikan upaya preventif terkait perlindungan hukum terhadap hak dan kewajiban kepada para pegawai PKWT khususnya di PT IK;

The purpose of this research are: (1) To find out and examine the related legal protection for workers with a particular Time Work Agreement system at PT IK : (2) To find out and inspect the legal protection provided by the Madiun City Manpower Office for contracted workers at PT IK. This research is a normative legal research supported by interviewees. Normative legal research is carried out with library research by tracing secondary data in the form of primary legal materials, secondary legal materials and tertiary legal materials, with documentation methods and tools in the form of document studies. Interviews were conducted with informants using tools in the form of interview guidelines. Data analysis uses qualitative analysist. Based on the results of research and discussion of legal protection of wages and working hours for contracted workers at PT IK, it is known that the legal protection that has been applied by companies to contracted workers includes several aspects, namely; 1) legal protection of wages; 2) legal protection related to workers' associations; 3) legal protection for female employees; 4) legal protection related to working hours and; 5) legal protection related to occupational health and safety. The results of the research and discussion can be drawn from the following conclusions: 1) Legal protection undertaken by PT IK for contracted workers in the company is not so optimal, this is because there are still violations of legal protection of wages and working hours to contracted workers in PT IK which has not been maximally protected; 2) The contents of certain time work agreements at PT IK are not in line with the applicable laws and regulations, as the rules in PT IK certain time work agreements for overtime pay for contracted workers are paid with a flat system; 3) Efforts that have been made by the Manpower and Transmigration Office of Madiun City towards the legal protection of PKWT workers at PT IK have been going well so far and the relevant parties also often do socialization related to the Manpower Act regulations in order to create a comfortable and prosperous work atmosphere; 4) Therefore, it is recommended that PT IK be expected to maximize in providing legal protection related to wages and working hours for contracted workers in the company; 5) The Manpower and Transmigration Office of Madiun City is also expected to be more massive and regular in providing preventive measures related to legal protection of rights and obligations for contracted workers, especially at PT IK; Keywords: Legal Protection, Wages Working Hours, PKWT.
