ANALISIS YURIDIS PUTUSAN PENGADILAN NEGERI DENPASAR NOMOR 439/PDT.G/2016/PN DPS TENTANG SENGKETA PEMBAGIAN TANAH WARIS (STUDI KASUS SENGKETA WARIS DI KOTA DENPASAR-BALI)

Penelitian ini bertujuan untuk mengetahui proses turun waris dan pembagian harta bersama melalui pembuatan Akta Pembagian Hak Bersama (APHB) serta menganalisis Putusan Pengadilan Negeri Denpasar Nomor 439/Pdt.G/2016/PN Dps terkait dengan adil tidaknya putusan dan perlindungan hukum yang diberikan oleh putusan bagi para pihak yang bersengketa. Penelitian ini merupakan penelitian yang dilakukan dengan metode normatif empiris dengan menggunakan data primer yang diperoleh secara langsung dari lapangan melalui wawancara dengan narasumber dan responden dan data sekunder yang diperoleh melalui penelitian kepustakaan yang datanya bersumber dari sumber hukum primer, sumber hukum sekunder, dan sumber hukum tersier. Data yang diperoleh dianalisis menggunakan cara deskriptif kualitatif agar data yang dipilih dapat menjelaskan dengan tepat dan rinci terkait dengan rumusan permasalahan. Berdasarkan hasil penelitian dan pembahasan yang telah diuraikan dalam penelitian ini, diperoleh kesimpulan: pertama, proses turun waris dilakukan di Kantor Pertanahan dengan berlandaskan surat keterangan ahli waris, Akta Pembagian Waris (APW), atau Akta Pembagian Hak Bersama (APHB). Pembuatan APHB merupakan wewenang dari Pejabat Pembuat Akta Tanah (PPAT). Pendaftaran Tanah karena pewarisan di Kantor Pertanahan mengikuti ketentuan Peraturan Menteri Agraria Nomor 3 Tahun 1997. Kedua, Putusan Pengadilan Negeri Denpasar Nomor 439/Pdt.G/2016/PN Dps., telah diputuskan oleh Hakim secara adil berdasarkan kearifan lokal masyarakat Bali dalam pewarisan dan perlindungan hukum yang diberikan oleh putusan ini bersifat perlindungan hukum represif karena perlindungan hukum tersebut baru diberikan setelah terjadinya sengketa dan tujuan adanya perlindungan tersebut adalah untuk menyelesaikan sengketa.

This research aims to study the process of inheritance and division of joint assets through the formation of the Deed of Sharing Common Rights (APHB) and to analyse the fairness and legal protection in Denpasar District Court decision Number 439/Pdt.G/2016/PN Dps. This research is a study conducted through the emphirical normative method using primary data that obtained directly from the field through interviews with interviewees and respondents and secondary data that obtained through literature research whose data is sourced form the primary legal source, secondary legal resources, and tertiary legal resources. The data obtained were analysed using qualitative descriptive methods so that the selected data could explain precisely and in detail related to the formulation of the problem. Based on the results of research and discussion that has been described in this study, conclusions are obtained: first, the process of inheritance is carried out in Land Office based on letter of the beneficiary, the Inheritance Deed (APW), or Deed of Sharing Common Rights (APHB). The formation of Joint Rights Distribution Act (APHB) is the authority of the Land Deed Making Officer (PPAT). Land registration due to the inheritance at the Land Office follows the provisions in Regulation of The Minister of Agrarian Number 3 year 1997. Second, the decision of the Denpasar District Court No. 439 / Pdt.G / 2016 / PN Dps., Has been decided fairly by the Judge based on local wisdom of the Balinese people in inheritance and legal protection provided by this decision is repressive legal protection because the legal protection is only given after the dispute and the purpose of the protection is to resolve disputes.
