Penelitian ini bertujuan untuk mengetahui bagaimana perlindungan hukum terhadap kepentingan pemegang hak cipta dari waralaba yang didalamnya terdapat hak cipta yang dijadikan sebagai objek jaminan fidusia ketika terjadi eksekusi dan untuk mengetahui apakah proses eksekusi objek jaminan berupa surat berharga yang dapat dijadikan sebagai jaminan merubah atau mempengaruhi kedudukan pemegang hak cipta. Penelitian ini merupakan penelitian normatif empiris yaitu . Dikatakan empiris karena melihat bekerjanya hukum di masyarakat, bertitik tolak dari permasalahan dengan terjun langsung melihat kenyataan yang terjadi di lapangan, kemudian menghubungkannya dengan peraturan perundang-undangan yang berlaku. Hasil penelitian ini adalah 1).Bentuk perlindungannya berupa tindakan perlindungan preventif (pencegahan) yaitu mencantumkan klausul perlindungan kejelasan status untuk dipenuhinya hak pencipta hasil dari perjanjian izin lisensi , dan represif (penanggulangan) yaitu perlindungan yang muncul dari peraturan yang berlaku. 2).ketika terjadi eksekusi pemegang hak cipta statusnya tidak terganggu atau berubah karena pemegang hak cipta adalah orang yang berada diluar perjanjian.

This study aims to find out the legal protection of copyright holders interests of the franchise that its copyright which is used as an object of fiduciary guarantee when the execution occurs and to determine whether the process of execution of the collateral object in the form of securities that can be used as a guarantee to change or affect the position of the copyright holder. This research is an empirical normative research that is said to be empirical because it sees the operation of law in the society, it started from the problem by going into the field to see it, then connected it with the applicable laws and regulations. The results of this study are 1). The form of protection they get are preventive protection (preventive) that includes protection clause for status clarity for the fulfillment of the creator's rights from the license permit agreement, and repressive (countermeasures) is protection arising from applicable regulations. 2). When the execution of a copyright holder's status is not interrupted or changed because the copyright holder is a person who is outside the agreement.
