PERANAN PPAT DALAM MEMBERIKAN PEMAHAMAN KEPADA KONSUMEN ATAS AKTA JUAL BELI PROPERTI SIGNATURE PARK APARTMENT DI JAKARTA SELATAN

Penelitian ini bertujuan untuk mengetahui dan mengkaji mengenai bentukbentuk dan sejauh mana peranan PPAT sebagai pejabat public dan Law advisor dalam memberikan pemahaman terhadap Akta Jual Beli yang dibuatnya kepada konsumen properti di Signature Park Apartment, serta implementasi perlindungan hukum yang diberikan oleh PPAT dalam Akta Jual Beli terhadap konsumen. Penelitian ini merupakan penelitian yang bersifat penelitian empiris atau penelitian lapangan yang dilakukan untuk mendapatkan data primer yang kemudian didukung data sekunder dari penelitian kepustakaan. Seluruh data yang terkumpul dianalisa dengan metode kualitatif. Hasil penelitian menunjukkan bahwa peranan PPAT dalam memberikan pemahaman terhadap Akta Jual Beli yang dibuatnya kepada konsumen telah melaksanakan tugasnya sesuai dengan aturan jabatan PPAT dan kode etik yang berlandaskan pada asas proporsionalitas. Namun, kurangnya kontribusi dari pihak pengembang satuan rumah susun untuk memberikan informasi yang sejelas-jelasnya mengakibatkan konsumen menganggap perlunya diadakan penyuluhan dan penjelasan mengenai Akta Jual Beli serta akibat-akibat hukum yang ditimbulkan dikemudian hari yang bertujuan untuk memberikan pemahaman terhadap perbuatan hukum yang akan dilakukan oleh konsumen. Implementasi perlindungan hukum yang diberikan oleh PPAT dalam Akta Jual Beli terhadap konsumen adalah ketika PPAT telah membacakan Akta Jual Beli, PPAT memberikan kesempatan kepada konsumen untuk mengajukan pertanyaan. Namun dalam praktiknya konsumen cenderung pasif yang mengakibatkan terjadinya ketidakpahaman dan dapat merugikan konsumen dikemudian hari

This study was conducted to explore and review how the roles of Land Deed Officer as Public Official and Law advisor on giving an understanding to Signature Park Apartment's consumers about the Deed of Sales & Purchase that he/she have been made, and the implementation of legal protection to the consumer that have been provided by the Land Deed Officer on the Deed of Sales & Purchase. This study was an empirical study. Primary data were collected from the field, while the secondary data were obtained from literature review to support the primary data. The data obtained in this study were qualitatively analyzed. The results of this study showed that the roles of Land Deed Officer on giving an understanding to Signature Park Apartment's consumers about the Deed of Sales & Purchase had been done, according to Land Deed Officer's rules and codes of ethics that based on the principle of proportionality. However, the lack of contributions from the apartment's developer to give a crystal clear information made consumers thought the need of counseling and explanations about the Deed of Sales & Purchase and legal consequences that could happen in the future so that consumers understand toward legal acts that they would do. The implementation of legal protection to the consumer that have been provided by the Land Deed Officer on the Deed of Sales & Purchase was when the Land Deed Officer read the Deed of Sales & Purchase to the consumers, he/she gave consumers chances to ask questions. However, consumers were a bit passive that cause incomprehension and could disadvantaging consumers in the future
