ANALISIS KEPATUHAN PKL TERHADAP KEBIJAKAN PEMERINTAH (Studi Kasus di Kecamatan Bojonegoro)

Penelitian ini dilatarbelakangi oleh informasi dari berbagai media massa dan aplikasi online pemerintah untuk menampung aspirasi masyarakat bahwa di Kecamatan Bojonegoro telah memiliki keluhan masyarakat terkait keberadaan pedagang kaki lima (PKL) menyebabkan hilangnya akses ruang publik dan lingkungan yang kumuh hingga tahun 2018. Sehingga hal tersebut perlu dipertanyakan upaya yang dilakukan pemerintah Kabupaten Bojonegoro dalam mengatasi masalah permasalahan tersebut. Sementara Kabupaten Bojonegoro merupakan Kabupaten yang terkenal dengan pemimpin atau bupati yang menjabat tahun 2008-2018 yang mampu memberikan inspirasi rakyatnya. Adapun pada kepimpinan bupati tersebut telah terdapat beberapa kebijakan terkait penataan/penertiban PKL yang mengatur 5 perihal yang diatur (waktu, tempat, peralatan, kebersihan dan kesehatan) dan melakukan kegiatan untuk mengimplementasikannya. Namun, sesuai informasi dari beberapa media massa terdapat 3 perihal yang diatur (waktu, tempat, peralatan) banyak tidak dipatuhi. Hal tersebut mengisaratkan terdapat kegagalan implementasi kebijakan pemerintah Kabupaten Bojonegoro terkait penataan/penertiban PKL yang disebabkan PKL Kecamatan Bojonegoro kurang patuh terhadap kebijakan tersebut. Oleh karena itu, penelitian ini, memiliki tujuan utama untuk menganalisis alasan atau penyebab para PKL di Kecamatan Bojonegoro kurang patuh terhadap kebijakan pemerintah Kabupaten Bojonegoro yang masih berlaku hingga tahun 2018. Namun, dalam menganalisis hal tersebut juga telah dijabarkan penyajian secara konkrit/realitas tingkat kepatuhan PKL terhadap kebijakan pemerintah untuk memperkuat argumen penulis untuk menjelaskan fokus utama penelitian ini. Metode penelitian yang digunakan dalam penelitian ialah menggunakan jenis penelitian studi kasus dengan pendekatan kualitatif. Data yang digunakan ialah jenis data primer dan sekunder. Data primer bersumber dari informan yang dilakukan wawancara, peristiwa yang dilakukan pengamatan atau observasi, dan dokumentasi. Data sekunder diperoleh dari dokumen yang dikumpulkan orang lain dan juga peraturan-peraturab yang berhubungan dengan penelitian ini tentang realitas tingkat kepatuhan PKL dan penyebab PKL kurang patuh kebijakan. Hasil penelitian menunjukkan bahwa realitas tingkat kepatuhan PKL Kecamatan Bojonegoro terhadap kebijakan pemerintah Kabupaten Bojonegoro cenderung kurang patuh terhadap kebijakan tersebut. Adapun penyebab yang menjamin PKL Kecamatan Bojonegoro cenderung kurang patuh terhadap kebijakan tersebut dikarenakan tingkat kesadaran yang sedang, pengawasan yang tidak intensif, penegakan hukum yang tidak tegas, tidak tersedianya fasilitas yang strategis, bebas biaya, dan adil bagi seluruh PKL, dan perilaku pemimpin yang tidak konsisten terhadap kebijakan yang dibuat dan disetujui, serta perilaku pemimpin yang tidak fokus atau serius pada permasalahan yang dialami PKL. Dari penyebab-penyebab tersebut yang utama ialah perilaku pemimpin yang tidak konsisten yang juga menjadi akar penyebab penegakan hukum yang tidak tegaas dan perilaku pemimpin tidak serius terhadap permasalahan PKL yang juga menjadi akar penyebab tidak tersedianya fasilitas strategis, bebas biaya, dan adil.

This research based from many mass media source information and government online application to accomodate community aspiration about the complaint of people in Bojonegoro sub-district related to the existence of street vendor caussing loss of access to public space and dirty environment until 2018. Thats problem make many people question the efforts made by Bojonegoro government to solve that. Although Bojonegoro regency has a regent (2008-2018) known to always give inspiration to his people, the problem about street vendor still unsolved until now. as for the leadership of that regent has a many policy in street vendor regulations that contain five point (time, place, tools, sanitation and health) and activities to be implemented. But, many sourcce from mass media says there are three regulated point (time, place, tools) that not compliant by the street vendors itself. Its suggested that Bojonegoro government failure to implement the regulation of street vendor policy because many of them not compliant to the policy. For that reason, this research have main objective to anilisis the cause of why many street vendor is less compliant to the government policy althought that policy still apply until 2018. But in the following analysis of this problem, has also contain concrete presentation about compliance level of street vendor to the policy for strengthen the writer argument in this research main focus. Research metode that used in this thesis use case study research with qualitative approach. The data that used are primary data and secondary data. Primary data come from the informant with interview methode, scouting or observation, and documentation. Secondary data come from the document that collected from another person and policies which is related with this research about the street vendors level of compliance and the cause of it. The result of this research indicate that the reality of street vendors compliance level in bojonegoro sub-district to the Bojonegoro government policy tend to less compliant to that policy. The primary cause of that problems are because the level awareness is to moderate, less intensive surveillance, indesicive law enforcement, there are no strategic facilities, free of charge, and fair to the street vendors, and the inconsistent leader habits toward the made and approved policy, and also the habits of the leaders who is not focus or serious to the problem that happened to the street vendors. From many cause above, the main problem is come from the habits of the leader who is not consistent that make indesicive law enforcement and the leader behavior who is not serious toward the street vendors problems that cause the less many strategic facilities, free of charge and fair.
