2018 | Tesis | MAGISTER ILMU HUKUMPenelitian ini bertujuan untuk menganalisis permasalahan yang menghambat penyelenggaraan pelayanan perizinan usaha di Kabupaten Bantul serta memberikan rekomendasi langkah hukum yang perlu dilakukan oleh Pemerintah Kabupaten Bantul untuk menyelesaikan permasalahan tersebut terutama jika merujuk pada good practices di Kabupaten Boyolali. Metode yang digunakan dalam penelitian ini adalah penelitian hukum normatif empiris, dengan melakukan studi perbandingan hukum antara Kabupaten Bantul yang terindikasi adanya permasalahan dalam penyelenggaraan perizinan usaha dengan Kabupaten Boyolali sebagai penyelenggara PTSP terbaik ketiga di Indonesia. Permasalahan penyelenggaraan pelayanan perizinan usaha di Kabupaten Bantul yang panjang dan berbelit-belit disebabkan oleh sistem perizinan yang bertahap, persyaratan yang rumit untuk dipenuhi, pengecekan lokasi oleh beberapa instansi, bentuk dan kewenangan kelembagaan yang belum mencerminkan konsep PTSP, dan regulasi daerah yang tidak sinkron baik antara peraturan tingkat daerah, maupun dengan peraturan tingkat pusat sebagai acuan pembuatannya. Oleh karena itu, guna meningkatkan kualitas pelayanan publik di bidang perizinan usaha di Kabupaten Bantul diperlukan upaya optimalisasi melalui penyederhanaan prosedur perizinan, menghilangkan tahapan/jenis perizinan yang dasar hukumnya telah dihapus, pengajuan persyaratan secara simultan, pengecekan lokasi yang terintegrasi dan terkoordinir, pengembangan sistem perizinan online, dan penataan kelembaan perizinan melalui penyatuan seluruh proses pelayanan perizinan melalui pelimpahan kewenangan perizinan termasuk pendaftaran rekomendasi yang menjadi prasyarat perizinan usaha kepada Dinas Penanaman Modal dan Pelayanan Terpadu (DPMPT) Kabupaten Bantul.
The objective of this research is to analyze the problem that blocks the organization of business license services in Bantul Regency. It is also to provide the recommendation of legal action that needs to be done by the Government of Bantul Regency to solve the problem, especially when referring to good practices of the organization of business license services in Boyolali Regency. The method used in this research is normative-empirical legal research, by conducting comparative legal studies between Government of Bantul Regency that indicated problems in the implementation of business licensing with Goverment of Boyolali Regency as the best third provider PTSP in Indonesia. The problem of the organization of the business licensing service in Bantul Regency is the process that takes more time and complicated. This is caused by: the licensing system is gradual, the requirement is not easy to be fulfilled, the business location should be checked by some government agency, the authority and shape of the institution is not yet reflecting the concept of PTSP, the local regulation is not yet synchronous among local regulation. It also happens to the national regulation, although this regulation is the guide in the establishment of local regulation. Therefore, in order to improve the quality of public services in business licensing in Bantul Regency, it is necessary to optimize efforts through: the licensing procedure is simplified, the stages/types of licenses, that legal basis has been removed, is deleted the application requirements are submitted simultaneously, the location inspection is integrated and coordinated by, the application of licensing is developed to online system, and the licensing institution should be arranged through the unification of the entire licensing service process where it is conducted by authority transfer of licensing that includes the recommendation registration which becomes the prerequisite of business licensing to DPMPT of Bantul Regency.
