ANALISIS KEBIJAKAN MANAJEMEN KARIER DAN PROMOSI PEGAWAI DI LINGKUNGAN PEMERINTAH KABUPATEN KLATEN DALAM PERSPEKTIF HUKUM ADMINISTRASI NEGARA

Penelitian ini bertujuan untuk mengetahui dan menganalisis aturan hukum yang mengatur tentang promosi jabatan administrasi PNS, baik regulasi nasional ataupun regulasi di Pemerintah Kabupaten Klaten khususnya, kemudian menganalisis pelaksanaan dari aturan hukum tersebut. Penelitian ini bersifat empiris normatif yang bertujuan untuk memperoleh gambaran secara normatif dan menganalisis pelaksanaan dari aturan hukum mengenai promosi jabatan administrasi PNS di Kabupaten Klaten. Sarana yang digunakan dalam pengumpulan bahan hukum primer dengan berpedoman pada Undang-Undang Nomor 5 Tahun 2014 tentang Aparatur Sipil Negara, Peraturan Pemerintah Nomor 11 Tahun 2017 tentang Manajemen Pegawai Negeri Sipil, Salinan Putusan Perkara Tipikor Nomor 55/Pid.Sus-TPK/2017/PN Semarang atas nama terdakwa Sri Hartini, sedangkan bahan hukum sekunder dengan studi dokumen. Hasil penelitian menunjukkan bahwa Surat Edaran Sekretariat Daerah Kabupaten Klaten Nomor: 800/1252/29 Tahun 2017 perihal Ralat Uji Kompetensi, menimbulkan multi tafsir karena surat edaran tersebut mengindikasikan adanya kemungkinan persyaratan yang akan disimpangi ketentuannya. Diketahui bahwa Surat Edaran tersebut muncul untuk meralat Surat Edaran Sekretariat Daerah Kabupaten Klaten Nomor: 800/1241/29 Tahun 2017 perihal Uji Kompetensi, yang mana Surat Edaran Sekretariat Daerah Kabupaten Klaten Nomor: 800/1252/29 Tahun 2017 perihal Ralat Uji Kompetensi mengubah sebagian isi dari Surat Edaran Sekretariat Daerah Kabupaten Klaten Nomor: 800/1241/29 Tahun 2017 perihal Uji Kompetensi, yaitu yang isinya terkait dengan persyaratan kualifikasi kepemilikan Sertifikat Diklatpim/ STTPL dan Sertifikat Ahli Pengadaan Barang dan Jasa Pemerintah yang bukan lagi menjadi persyaratan mutlak, namun lebih kepada persyaratan tambahan. Berdasarkan Salinan Putusan atas nama terdakwa Sri Hartini terungkap maraknya kasus jual beli Jabatan di Pemerintah Kabupaten Klaten, diketahui ternyata transaksi jual beli jabatan dilakukan oleh terdakwa di rumah dinas Bupati. Uangnya ada yang langsung diserahkan ke terdakwa, ada yang melalui ajudannya, melalui satpam dan sopir yang merupakan orang-orang dekat terdakwa.

This study aims to identify and analyze how the legal rules governing the promotion of civil servants, both national regulations in general or regulations in the Government of Klaten Regency, then analyze the implementation of these laws, and describe the legal design that needs to be done in order to minimize the occurrence of irregularities from the implementation of the rules of the promotion of civil servants in the Government of Klaten Regency. This research is a normative empirical that aims to obtain a normative description and analyze the implementation of the rule of law regarding the promotion of civil servants in Klaten regency. The means used in the collection of primary legal materials are by referring to Law No. 5 of 2014 on State Civil Apparatus, Government Regulation No. 11 of 2017 on the Civil Service Management, Decision of Corruption Case No. 55 / Pid.Sus-TPK / 2017 / PN Semarang on behalf of the accused Sri Hartini, meanwhile for secondary law materials used document studies of literatures. The results showed that the Circular Letter of the Regional Secretariat of Klaten Regency Number: 800/1252/29 concerning the Competency Test, caused a problem because the circular indicated the possibility that the requirements will be abused in provisions. It is known that the Circular Letter appears to rectify Circular Letter of Regional Secretariat of Klaten Regency Number: 800/1241/29 concerning Competency Test, which is Circular Letter of Regional Secretariat of Klaten Regency Number: 800/1252/29 concerning Competency Test to change some of the contents of Circular Letter Regional Secretariat of Klaten Regency Number: 800/1241/29 regarding Competency Test, which is related to the qualification requirements related to the ownership of the Certificate of Diklatpim / STTPL and the Certificate of Procurement of Government Goods and Services becomes not an absolute requirement, but more to the additional requirements. Based on the copy of the Decision on behalf of the accused Sri Hartini revealed many cases of buying and selling positions in the Government of Klaten Regency, It is known that buying and selling positions conducted by the defendant in the regent's official residence. The money was directly handed over to the defendant, some through her aide, through a security guard and a driver who were close to the defendant.
