TINJAUAN PELAKSANAAN PELEPASAN INFORMASI MEDIS UNTUK KEPERLUAN PEMBUATAN VISUM ET REPERTUM DI INSTALASI REKAM MEDIS RSUD KABUPATEN INDRAMAYU

Latar belakang : Secara umum informasi yang terdapat dalam rekam medis sifatnya rahasia dan harus dijaga kerahasiaannya. Visum et repertum merupakan alat bukti yang sah menurut undang-undang. Berdasarkan studi pendahuluan di RSUD Kabupaten Indramayu terdapat permasalahan yaitu ketidaksamaan persepsi antara penyidik dengan dokter pembuat visum et repertum terhadap Peraturan Perundang-undangan mengenai permintaan visum et repertum yang dilakukan secara lisan melalui via telepon, beban psikologis dari dokter pembuat visum et repertum terhadap risiko hukum antara lain waktu tunggu persidangan yang lama dan harus berurusan dengan pihak pengadilan, serta kebanyakan pasien meminta visum et repertum tanpa mempunyai surat permintaan visum et repertum dari penyidik kepolisian. Tujuan : Mendeskripsikan pelaksanaan pelepasaan informasi medis dan pelaksanaan pembuataan visum et repertum, serta menganalisis kesesuaian antara pelaksanaan dan standar prosedur operasional yang berlaku. Metode : Jenis penelitian adalah deskriptif evaluatif dengan rancangan penelitian studi kasus. Teknik pengambilan datanya menggunakan observasi, wawancara, dan studi dokumentasi. Subjek penelitian terdiri dari dokter IGD, dokter kandungan, petugas rekam medis dan penyidik kepolisian. Hasil : Pelepasan informasi medis di RSUD Kabupaten Indramayu tidak menggunakan surat kuasa atau formulir persetujuan dari pasien. Kasus yang dapat dimintakan adalah jenis kasus korban hidup/visum luar. Peran petugas rekam medis adalah sebagai pelaksana administrasi pembuatan visum et repertum, peran dokter sebagai saksi ahli, dan peran penyidik kepolisian sebagai pemohon kepada ahli (dokter). Kendala pembuatan visum et repertum dibedakan menjadi dua macam faktor yaitu sumber daya manusia dan sarana prasarana. Ketidaksesuaian masih terjadi antara pelaksanaan dengan standar prosedur operasioal yang berlaku. Kesimpulan : Pelepasan informasi medis belum sesuai dengan standar prosedur operasional yang berlaku. Peranan masing-masing pihak yang bertanggungjawab dalam pembuatan visum et repertum sudah sejalan dengan peraturan perundang-undangan di Indonesia. Pelaksanaan pembuatan visum et repertum di lapangan ada yang sudah sesuai dan tidak sesuai dengan standar prosedur operasional pengelolaan visum et repertum yang ada. Saran yang diberikan adalah menyamakan persepsi antara petugas rekam medis, dokter, dan penyidik kepolisian terkait pelaksanaan pembuatan visum et repertum harus sesuai dengan peraturan perundang-undangan di Indonesia.

Background : In general, the information that contained in the medical record is confidential and it should be kept confidential. Visum et repertum is a valid evidence based on the law. In producing Visum et repertum need a collaboration between the doctor, medical recorder, and police investigators in accordance to the professional ethics. Based on the preliminary studies in Indramayu Hospital there were some problems such inequality perseption between the police investigator or prosecutor and the doctor who make a Visum et repertum which are the legislation about visum et repertum request by telephone and also doctor’s psychological burden. Who make the Visum et repertum about the legal risks and waiting time to trial and dealing with the court. On the other hand the patients request visum et repertum without request letter from police investigator. Purpose : Describing the implementation of the release of medical information and producing Visum et repertum, and also analyzing the compatibility between the implementation and the application of standard operating procedures. Method : The type of this research was descriptive evaluative with research design is case study. The data was taken by observation, interview, and documentation. Results : The release of medical information in Indramayu Hospital did not use the power of attorney or a consent form from the patient. The case that may be requested was kind of victims alive / outside visum case. The role of medical record officer is as an administrative executor in producing visum et repertum, the role of doctor as an expert witness, and the role of police investigator as applicant to the specialist. The constraints of producing visum et repertum consists of two factors there are human resources and the facilities include the infrastructures. The incompatibility still occur between the implementation and the application of standard operating procedures. Conclusion : The release of medical information in Indramayu hospital is not in accordance with the applicable standard of operational procedures. The role of the parties which is responsible in producing visum et repertum are in line with the law in Indonesia.
