Resolusi Konflik Lingkungan Melalui Proses Mediasi Oleh Pemerintah Daerah Studi Kasus: Konflik PT Rayon Utama Makmur Dengan Masyarakat Kecamatan Nguter

Upaya Kabupaten Sukoharjo untuk melakukan modernisasi industri dengan memberikan izin pendirian PT Rayon Utama Makmur, telah mendorong terjadinya konflik lingkungan sebagai konsekuensi dari keberadaan suatu industri. Konflik yang terjadi diantara PT Rayon Utama Makmur dengan Masyarakat Kecamatan Nguter merupakan salah satu konflik lingkungan yang terjadi di Jawa Tengah. Sejak beroperasinya PT RUM, konflik mulai terjadi karena keresahan terjadi di masyarakat akibat bau yang dihasilkan oleh PT RUM. Akibat bau tersebut masyarakat mulai mengalami gangguan kesehatan berupa ISPA. Masyarakat melakukan aksi demonstrasi kepada perusahaan dan pemerintah sebagai bentuk upaya advokasi yang telah dilakukan. Konflik tidak dapat diselesaikan kedua belah pihak sehingga membutuhkan pihak ketiga berupa mediator. Pihak ketiga tersebut adalah Pemerintah Kabupaten Sukoharjo. Mediasi telah dilakukan tetapi konflik masih saja terus terjadi hingga sekarang. Tulisan ini berupaya mengeksplorasi secara mendalam untuk mengetahui penyebab mediasi yang sudah dilakukan oleh Pemerintah Kabupaten Sukoharjo tidak efektif. Kerangka pikir yang dibangun adalah bagaimana mediasi yang dilakukan oleh Pemerintah Kabupaten Sukoharjo menggunakan teori mediasi yang ada. Peneliti menggunakan pendekatan kualitatif untuk memahami fenomena secara lebih mendalam dan komperhensif. Data yang diambil melalui wawancara sebagai data primer yang didukung dengan dokumen foto, media massa dan dokumen-dokumen pihak terkait sebagai data sekunder. Hasil analisis menunjukkan bahwa penyebab mediasi yang sudah dilakukan tidak efektif adalah pemilihan mediator tidak sesuai dengan prinsip mediasi. Kepercayaan masyarakat kepada pemerintah sebagai mediator sangat rendah, masyarakat terpecah menjadi dua kubu yakni, pro perusahaan dan kontra dengan perusahaan dan permasalahan inti yang belum dapat diselesaikan. Resolusi konflik yang dilakukan berupa mediasi belum mendapatkan hasil yang maksimal karena kedua belah pihak masih berkonflik hingga saat ini.

The conflict that occurred between PT Rayon Utama Makmur and Nguter sub-districts was one of the environmental conflicts that occurred in Central Java. Since the operation of PT RUM, conflicts have started to occur because of unrest in the community due to the odor produced by PT RUM. As a result of these odors, people are starting to experience health problems in the form of ARI. Conflict cannot be resolved by both parties so it requires a third party, a mediator. The third party is Sukoharjo Regency Government. Mediation has been carried out but conflicts continue to this day. This paper seeks to explore in-depth to find out the causes of mediation that have been carried out by the Government of Sukoharjo Regency are not effective. The framework for thinking is how the mediation carried out by the Government of Sukoharjo Regency uses existing mediation theories. The writer uses a qualitative approach to understand phenomena more deeply and comprehensively. Data were taken through interviews as primary data supported by photo documents, mass media and related party documents as secondary data. The results of the analysis showed that the cause of the mediation that had been carried out ineffectively was the selection of mediator not by the principle of mediation. Community trust in the government as a mediator is very low, the community is divided into two camps, a pro with the company and the cons with the company and the core problems that cannot be resolved. Conflict resolution carried out in the form of mediation has not yet gotten maximum results because both parties are still in conflict today.
