Prinsip Efektif Dan Prinsip Efisien Dalam Penggabungan Pekerjaan Engineering, Procurement, Construction (EPC) Dan Operation & Maintenance (O&M) dalam Kontrak Konstruksi Pengadaan Pusat Listrik di PT PLN (Persero)

Penelitian ini bertujuan untuk mengetahui latar belakang serta mengetahui dan mengkaji mengenai pemenuhan prinsip efektif dan prinsip efisien penggabungan pengadaan pekerjaan engineering, procurement, construction(EPC) dan operation & maintenance (O&M) di PLN. Jenis penelitian adalah penelitian hukum normatif empiris, menggunakan bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier. Data primer diperoleh melalui wawancara, jenis wawancara yang digunakan adalah wawancara bertahap, data sekunder diperoleh menggunakan metode dokumentasi studi kepustakaan. Hasil penelitian menunjukkan bahwa latar belakang PLN dalam menggabungkan pengadaan EPC dan O&M adalah untuk memperoleh jaminan terhadap kualitas pembangkit pada masa kritis pembangkit, penggabungan EPC dan O&M di Amerika juga terbukti mempersingkat durasi pembangunan dan mampu menghemat biaya pengadaan. Selanjutnya tindakan PLN untuk menggabungkan pengadaan EPC dan O&M telah sesuai dengan kewenangan PLN untuk menentukan strategi pengadaan. Penggabungan pengadaan EPC dan O&M telah memenuhi prinsip efektif dan prinsip efisien karena telah sesuai dengan aturan pengadaan dan undang-undang Jasa Konstruksi, klausul dalam dokumen pelelangan dan kontrak dapat mengikat kontraktor untuk memberikan jaminan terhadap kualitas pembangkit pada masa kritis pembangkit. Penggabungan pengadaan EPC dan O&M telah memangkas proses pengadaan di unit PLN, sehingga menghemat biaya pengadaan dan sumber daya manusia.

This researchwas intended to determine the background and also find out and study the fulfilment of the effective and efficient principles of combining Engineering, Procurement, Construction (EPC) and Operation &Maintenance (O&M) in PLN. The research usednormative-empirical legal research, using primary legal materials, secondary legal materials and tertiary legal materials. Primary data were obtained through interviews with the type of interview used was a gradual interview and the secondary data were obtained using the method of literature study documentation. The results have shown that the background of PLN in combining the procurement of EPC and O&M was to obtain a guarantee of the quality of the plant at the critical time of it. The merger of EPC and O&M in America was also proven having shortened the duration of development andable to save procurement costs. Furthermore, PLN's actions to combine the procurement of EPC and O&M are in accordance with PLN's authority that is to determine the procurement strategy. The merging of the procurement of EPC and O&M, done by PLN has fulfilled the effective and efficient principles because it is in accordance with the procurement rules and the Construction Services law.Clauses in tender documents and contracts can bind the contractor to provide guarantees to the quality of the plant at the critical time of it. The merger of the procurement of EPC and O&M has cut the procurement process in the PLN unit, thus it has saved the procurement costs and human resources.
