Positive Legislature Dalam Putusan Mahkamah Konstitusi

Penelitian ini bertujuan untuk mengetahui apa latar belakang Mahkamah Konstitusi menjatuhkan putusan yang bersifat positive legislature serta apa implikasinya dilihat dari paham konstitusionalisme. Penelitian ini dilakukan secara normatif yang mengedepankan studi kepustakaan dengan basis data sekunder, yaitu bahan hukum primer, sekunder dan tertier. Analisis data dilakukan dengan metode deskriptif analisis. Latar belakang putusan Mahkamah Konstitusi bersifat positive legislature adalah melindungi hak konstitusional warga negara dan mengisi kekosongan hukum baik sebelum maupun setelah pengujian undang-undang. Putusan Mahkamah Konstitusi yang bersifat positive legislature dilihat dari paham konstitusionalisme berimplikasi pada sistem ketatanegaraan serta kekuatan mengikat putusan yang bersifat positive legislature tersebut.

This study aims to find out the background of positive legislature in the Constitutional Court decision and the implications based on constitutionalism. This research was carried forward normative literature on the basis secondary data, the primary legal materials, secondary and tertiary. Data was analysis using descriptive analytic method. The background of positive legislature in the Constitutional Court decision are to protects the constitutional rights of citizens and fill the legal vacuum both before and after constitutional review. Positive legislature in the Constitutional Court decision viewed from the idea of constitutionalism was implied on constitutional system as well as the binding force that is both the Constitutional Court decision.
