EFEKTIVITAS PERDA KAB. SLEMAN NO 18 TAHUN 2012 TENTANG PERIZINAN PUSAT PERBELANJAAN DAN TOKO MODERN

Penelitian ini dilatar belakangi maraknya perkembangan toko modern di Indonesia, tak terkecuali di Kabupaten Sleman. Di Kabupaten Sleman sudah memiliki kebijakan terkait toko modern yaitu Peraturan Daerah No 18 Tahun 2012 tentang Perizinan Pusat Perbelanjaan dan Toko Modern, tetapi ternyata pelanggaran masih begitu tinggi. Banyak toko modern yang tidak memiliki izin dan terjadi banyak konflik dengan masyarakat. Hal tersebut sangat miris mengingat Peraturan Daerah No 18 Tahun 2012 ini sudah berjalan selama 3 tahun. Penelitian ini akan menggunakan metode deskriptif kualitatif. Teori yang digunakan adalah faktor-faktor yang mempengaruhi efektivitas kebijakan dari Grindle yang melihat dari dua faktor besar yaitu isi kebijakan dan konteks implementasi. Setelah ditelusuri, kebijakan ini bukan merupakan kebijakan pertama terkait toko modern di Kabupaten Sleman. Ada dua kebijakan yang sudah dikeluarkan pada tahun 2010. Hasil dari penelitian ini menunjukkan bahwa kebijakan ini belum efektif karena dari 338 toko modern sampai akhir tahun 2015 hanya 15 toko saja yang memiliki Izin Usaha Toko Modern seperti yang diwajibkan dalam Peraturan Daerah. Jumlah tersebut tentu sangat tidak ideal. Kemudian Pemerintah Sleman juga merilis 89 toko modern yang melanggar dan akan ditertibkan, sampai saat ini penertiban belum selesai. Melihat isi kebijakan tersebut, Peraturan Daerah ini berisi beberapa hal yang sulit diimplementasikan. Sementara sisi konteks implementasi, pemerintah melalui instansi terkait belum memiliki koordinasi yang baik dan tidak tegas dalam menegakkan Peraturan Daerah. Sehingga didapatkan kesimpulan bahwa tidak efektifnya Perda No 18 Tahun 2012 ini dikarenakan isi kebijakan yang masih kurang aplikatif dan sikap pemerintah yang tidak tegas dalam menegakkan peraturan daerah.

The development of modern stores which spread widely in Indonesia especially in Slemanunderlying the research has been conducted by the researcher. In Sleman, there has been a policy related to modern stores and it is a Local Regulation No. 18 in 2012 regarding the License of Shopping Centers and Modern Stores. However, the number of particular violation concerning the regulation is still high. A lot of modern stores that have no permits caused several conflicts with the people as well. It is quite distressing remembering the Local Regulation No. 18 in 2012 has been running for three years. This research is conducted using descriptive qualitative methods. The theories used for this research are from Grindle concerning factors influencing the effectiveness of the policy in which considering two major factors, the content and context of the implementation of the policy. Actually, the policy is not the only policy regarding modern stores in Sleman. There were two more policies that have been issued in 2010. The results of this research indicate that the policies have not been effective because there are only 15 from 338 stores until the end of 2015 which have the license as required by the Local Regulation. The total of the amount is certainly not ideal. Then Sleman government also released 89 modern stores which broke the policies will be disciplined but it is not finished yet. According to the content of the policy, the Local Regulation contains some cases that are difficult to be implemented. On the other hand, regarding the context of the implementation of the policy, the government has not yet owned a good coordination and not firm in upholding Local Regulation. It can be concluded that the ineffectiveness of the Local Regulation No. 18 in 2012 is due to the content of the policy which is still less applicable and the government�s attitude that is not firm enough in enforcing the Local Regulation.
