A Comparative Study: The Implementation of Diversion within The Juvenile Justice System under Indonesian Law and French Law

Pada dasarnya hak-hak anak dapat ditemukan di dalam Konvensi Hak-Hak Anak yang mengatur hak-hak anak yang sifatnya fundamental serta pelaksanaan perlindungannya. Ada 196 negara yang menjadi anggota dari Konvensi Hak Anak tersebut. Negara-negara anggota berkewajiban untuk memajukan hak-hak anak di tingkat regional. Perbandingan hukum ini bertujuan untuk mengidentifikasi persamaan dan perbedaan sistem peradilan anak di Indonesia dan Prancis. Di samping itu, penulis juga akan menjabarkan sistem hukum yang mana yang lebih sesuai dengan standar internasional untuk mengevaluasi serta menemukan solusi untuk kedua sistem hukum tersebut.

The Rights of the child are primarily laid out in the United Nations Convention on the Rights of the Child 1989 (CRC), containing fundamental rights of the child and its protection measures. Currently, there are around 196 countries bound by CRC. As consequence, the states parties have the obligation to promote the rights of the child in the regional level. This comparative study aims to identify what similarities and differences between two jurisdictions. Further, the author will discuss which legal system that tends to comply with the international standards and to evaluate as well as finding solutions for both legal systems.
