Implementasi Agreement on Import Licensing Procedures pada Kebijakan Impor Produk Hortikultura Pemerintah Indonesia

Agreement on Import Licensing Procedures merupakan salah satu persetujuan WTO yang mengatur mengenai lisensi impor yang harus dipatuhi oleh semua anggota WTO, termasuk Indonesia. Pada tahun 2013, kebijakan impor hortikultura Indonesia yang tertuang dalam Peraturan Menteri Perdagangan tentang Impor Produk Hortikultura dianggap telah melanggar ketentuan ILA oleh beberapa negara, salah satunya Amerika Serikat. Ketidakberhasilan dalam proses konsultasi di DSB memaksa kedua belah pihak menyelesaikan sengketa ini dihadapan Panel, dan sampai dengan saat ini proses penyelesaian sengketa di Panel masih berlangsung. Hasil penelitian menujukan bahwa satu dari lima kebijakan impor produk hortikultura Indonesia melanggar pasal 3.2 ILA. Pemerintah Indonesia telah menyiapkan tiga strategi utama dalam menghadapi gugatan ini di DSB, diantaranya menyiapkan argument untuk menghadapi gugatan Amerika, meyakinkan negara-negara untuk menjadi pihak ketiga, dan segera melakukan notifikasi atas perubahan Peraturan Menteri Perdagangan tentang Impor Produk Hortikultura.

Agreement on Import Licensing Procedures is one of the WTO Agreement which regulates with regards to the compulsory import licenses measure for all of the WTO members, including Indonesia. On the year of 2013, Indonesian Horticulture Import measure is being considered as a violation over ILA regulation by several states, one of them is United States. The unsuccessful process within the consultation at DSB forced both parties to settle this dispute in front of the Panel, and even until this moment dispute settlement process is still continuing at the Panel. The research results show that one from five horticulture product import measures in Indonesia violates Article 3.2 ILA. Indonesian Government has prepared three main strategies in facing this claim at DSB, preparing argument to face United States� claims, convincing other states to be the third parties, and immediately notifying states with respect to the revision of Trade Ministry Regulation on Horticulture Product Import.
