PENYELESAIAN KONFLIK TENURIAL KAWASAN HUTAN REGISTER 45 MESUJI LAMPUNG DALAM PERSPEKTIF KEADILAN

Penelitian ini bertujuan, untuk mengetahui dan menganalisis penyebab timbul konflik tenurial hutan di kawasan hutan Register 45 Mesuji Lampung. Mengkaji dan menganalisis penyelesaian konflik tenurial kawasan hutan Register 45 Mesuji Lampung berdasarkan peraturan perundang-undangan yang belum memenuhi rasa keadilan. Serta untuk mengetahui dan menganalisis konsep penyelesaian konflik tenurial hutan di Indonesia yang memenuhi rasa keadilan. Dengan jenis atau tipe penelitian ini hukum normatif empiris, maka diperoleh hasil penelitian: Pertama, Konflik tenurial hutan kawasan hutan Register 45 Mesuji Lampung disebabkan karena diterbitkanya izin pemanfaatan kawasan tersebut. Dampak perluasan, indisipliner, dan faktor ekonomi, politik, hukum, dan budaya merupakan bagian terbesar penyebab timbulnya konflik. Kedua, Peraturan perundang-undangan belum memenuhi rasa keadilan akibat begitu kompleksnya permasalahan yang ada di kawasan hutan Register 45 Mesuji Lampung. Penyelesaian konflik yang berkeadilan tidak saja tertuju untuk masyarakat perambah berhadapan dengan pihak pemegang izin. Semua harus dipandang secara holistik. Konvergensi atau keterpaduan antara substansi hukum, struktur penegak hukumnya dan kultur hukum dalam penyelesaian konflik yang memenuhi rasa keadilan merupakan mata rantai yang tidak boleh dilepaskan, sejak pembuatan aturan hukum, terjadinya kasus, proses penyelesaian, dan lembaga-lembaga terkait yang menangani. Semua itu merupakan citra kualitas proses sebagai jaminan kualitas manfaat aturan hukum yang diciptakan. Ketiga, Hukum haruslah dipahami sebagai realitas yang utuh dengan cara pandang holistik. Keadilan yang menyeluruh tidak hanya didasarkan pada kepentingan tertentu, golongan terbesar tertentu, akan tetapi didasarkan pada dinamika dan nilai-nilai yang mendasari keberadaan dan peruntukan hutan. Hutan mengandung nilai yang berbeda-beda, tergantung pada tempat dan waktu di mana tata nilai itu tumbuh dan berkembang. Dengan menekankan konsistensi pada keharmonisan (koheren), konsep penyelesaian konflik tenurial hutan berparadigma holistik mampu mengantarkan pada penyelesaian konflik yang menghadirkan keadilan.

This research aims to identify and analyze the causes of the emergence of forest tenurial conflict in the forest area of Register 45 in Mesuji Lampung; assess and analyzetenurial conflict resolution for forest area of Register 45 in Mesuji Lampung based on legislation that has not satisfied a sense of justice; as well as identify and analyzeconcepts of forest tenurial conflict resolution in Indonesia which satisfy a sense of justice. Employing a normative-empirical legal research, the research obtained results as follows: First, Foresttenurial conflicts in the forest area of register 45 in Mesuji Lampung was due to the issuance of the utilization permit in this area. The impact of the expansion, indiscipline, and economic, political, legal, and cultural factors are the biggest contributors of the conflict. Second, Laws and regulations have not satisfied the sense of justice due to the complexity of the problems that exist in the forest area of register 45 in Mesuji Lampung. A just conflict resolution is not only designated to forest encroachers against the permit holders. All parties should be perceived with the holistic paradigm. Convergence or coherence between legal substance, structure of law enforcement, and legal culture in conflict resolution that satisfies the sense of justice is a chain that should not be disconnected since the creation of the rule of law, the occurrence of the case, the process of resolution, and related institutions that deal with. All of them are image of the quality of process as a quality assurance about the benefits of the created rule of law. Third, the law should be understood as an intact reality with a holistic approach. Thorough justice is not only based on certain interests, certain largest group, but based on the dynamism and values that underlie the existence and designation of the forest. Forest contains different values, depending on place and time in which the value system grows and develops. By emphasizing consistency in harmony (coherence), the forest tenurial conflict resolution concepts with the holistic paradigm can achieve conflict resolution in order to provide justice.
