PERAN NOTARIS PASCA BERLAKUNYA UNDANG-UNDANG NO. 28 TAHUN 2004 TENTANG PERUBAHAN ATAS UNDANG-UNDANG NO. 16 TAHUN 2001 TENTANG YAYASAN DI KABUPATEN MAGETAN Ahmat Syaiful ., Abdul Ghofur Anshori, INTISARI Penelitian ini bertujuan untuk mengetahui peran notaris pasca berlakunya undang undang yayasan terkait proses penyesuaian anggaran dasar suatu yayasan, juga untuk mengetahui upaya yang sudah dilakukan oleh dinas terkait yang dalam hal ini kanwil hukum dan ham mengenai sosialisasi undang undang yayasan, serta mengetahui bagaimana sesungguhnya prosedur penyesuaian anggaran dasar suatu yayasan, megetahui bagaimana nasib jika suatu yayasan belum disesuaikan anggaran dasarnya berdasarkan undang undang yayasan dan mengetahui kendala-kendala apa saja yg muncul, serta mengetahui pula upaya upaya yang dilakukan dalam menyelesaikan kendala tersebut. Penelitian ini diharapkan dapat memberikan gambaran yang bersifat diskriftif empiris. Bersifat diskriptif karena dari hasil penelitian ini diharapkan dapat dijabarkan tentang azas hukum, kaidah hukum, serta pengaturan pengaturan yang berkaitan dengan pean notaris pasca berlakunya undang undang yayasan terkait penyesuaian anggaran dasar suatu yayasan di daerah kabupaten magetan, dan juga diharapkan dapat mengkaji dan menganalisa kendala kendala yang muncul serta dapat menyelesaikannya. Hasil penelitian diperoleh kesimpulan bahwa peran notaris berjalan sebagaimana mestinya dalam upaya mensosialisasikan undang undang yayasan baik secara langsung kepada pengurus yayasan ataupun secara tidak langsung melalui pemberitahuan, sedangkan upaya dari kanwil hukum dan ham dalam mensosialisakan undang undang yayasan tersebut dirasa sangat kurang di kabupaten magetan. Dan diharapkan pihak kanwil Hukum dan ham kabupaten magetan lebih aktif mensosialisasikannya. Serta diharapkan yayasan yang belum terdaftar d pengadilan negeri segera mendaftar diri agar diakui sebagai badan hukum yang sah. Kata kunci : Penyesuaian anggaran , Notaris, Kanwil Hukum dan Ham

This study also to know how is the process of adjustment the principles of consideration of foundation, and to know the foundation�s fate which still not adjust the principles of consideration based on foundation regulation, also to know the obstacles that appear and the efforts to solve the obstacles. This study is expected to provide a descriptive overview of empirical. This study is descriptive because from the result could be presented about the law principle, legal norm, and the regulation of foundation about process of adjustment the principles of consideration prevails in Magetan Regency. Besides that, the result of this study can examine and analyze the obstacles and the efforts to solve the obstacles. In conclusion, the role of the notary is running as in efforts to socialize law either directly to the foundation board of trustees or indirectly through notifications, whereas the efforts of the office area of law and human rights in Magetan to disseminating the law of the foundation feels very lacking. And the office area of law and human rights in Magetan expected more active to socialize the law. Besides that, the foundation that has not been registered in court expected registered immediately in order to be recognized as a legal corporation.
