TINDAKAN MAJELIS PENGAWAS DAERAH (MPD) TERHADAP PELANGGARAN TUGAS JABATAN NOTARIS DI KABUPATEN MAGELANG

Penelitian ini bertujuan untuk mengetahui dan menganalisis tindakan pengawasan terhadap pelanggaran tugas jabatan notaris dan mengetahui kendala-kendala yang dihadapi Majelis Pengawas Daerah di Kabupaten Magelang. Penelitian ini merupakan penelitian normatif empiris dengan data skunder dan primer.Data skunder diperoleh dari penelitian kepustakaan dengan metode dokumentasi dan alat pengumpulan data berupa studi dokumen.Data primer diperoleh langsung dari responden dan narasumber di lapangan melalui wawancara dengan alat pengumpulan data berupa pedoman wawancara.Data dianalisis secara kualitatif. Hasil penelitian ini menunjukkan bahwa pelanggaran tugas jabatan notaris diperoleh dari aduan masyarakat dan dari pemeriksaan. Peran MPD terkait pelanggaran yang diperoleh dari aduan masyarakat ialah dengan melakukan pemanggilan terhadap notaris yang didahului dengan laporan tertulis, kemudian MPD menyelenggarakan sidang terhadap notaris yang terindikasi melakukan pelanggaran tugas jabatan, hasil sidang pelanggaran tugas jabatan kemudian dilaporkan ke MPW untuk ditinjaklanjuti. Peran MPD terkait pelanggaran yang diperoleh dari pemeriksaan berkala ialah, MPD melakukan pembinaan kepada notaris bersamaan saat diadakan pemeriksaan berkala. Peran MPD terhadap pelanggaran tugas jabatan notaris di Kabupaten Magelang sudah berjalan sesuai dengan undang-undang jabatan notaris dan Peraturan Menteri Hukum dan Hak Asasi Manusia Republik Indonesia namun belum maksimal dan masih ditemukan kendala yang berasal dari MPD dan kendala yang berasal dari luar MPD.

The purpose of this research is to understand and to analyze the supervision acted and to recognize difficulties faced by district supervisor council for the violation of notary duties in Magelang regency. The research is empirical normative with secondary and primary data. The secondary data were obtained from library research by applying documentation method with document study as the data collection instrument. Meanwhile, the primary data were compiled directly from the respondents and interviewees in the field by conducting interview with interview guidelines as the data collection instrument. These data were analyzed in quantitative way. The result of this research indicates that the violations of notary duties are obtained from public complaints and evaluation by district supervisor council. District supervisor council role, related to the violations obtained from public complaints, is to call the notary which is preceded by a written report. Then, district supervisor council hold a trial against the notary that is indicated of doing violation duties, and its results will be reported to regional supervisor council for further action. Meanwhile, related to the violations obtained by routine evaluation, district supervisor council role is to do guidance towards notary in the same time they hold the routine evaluation. Based on above analysis, it can be concluded that district supervisor council role against violations of notary duties in Magelang regency has already ran in accordance with the notary constitution and the Indonesian Ministry of Justice and Human rights regulation. Somehow, it is not yet maximum and is still found problems derived both from district supervisor council itself and from the outside.
