TINJAUAN YURIDIS MENGENAI PERLINDUNGAN HUKUM TERHADAP PERS DALAM UNDANG-UNDANG NO.40 TAHUN 1999 TENTANG PERS

Keberadaan serta fungsi pers amatlah penting dalam kehidupan masyarakat saat ini, seakan sudah menjadi kbuuhan pokok pers selalu ditempatkan dalam posisis sebagai penyampai berbagai informasi pada masyarakat, penelitian ini ingin mengetahui apakah pers dalam hal ini wartawan tela dilindungi secara maksimal dalam Undang-undang No.40 Tahun 1999 tertang pers selanjutnya penetian ini juga memberi masukan perlindungan hukum yang ideal terhadap wartawan. Penelitian ini adalah penelitian pustaka yang menitik beratkan penelitiannya pada analisa naskah dan dokumen yang terkait dengan perasalahan yang diteliti sampai menemukan sebuah kesimpulan dan disusun dalam sistematika penelitan yang telah ditetapkan Dalam penelitian ini didapat kesimpulan bahwa pada ranah lembaga Pers perlindungan hukum sudah mulai muncul hal ini ditandai dengan tidak ada lagi kekhawatiran Lembaga Pers akan dicabut izin dan tidak boleh terbit lagi, temuan lain yangdidapat adalah Undang-undang perlindungan hukum terhadap Pers justru belum memberikan perlindungan hukum terhadap wartawan terutama perlindungan terhadap wartawan bila dihadapkan pada kepentingankepentingan pemilik modal dan mengarahkan wartawan pada kepentingan tertentu.

The media plays a central role as a supplier of information and a watchdog in every modern and democratic society. In fact, the press often also owns the power to influence the course of an important social phenomenon. With respect to this importance, this study will examine how the state has hitherto attempted to give legal protection to the members of the press. It will also try to investigate how the state can ideally use the law to protect the journalists. This is a qualitative research; data are collected through reviews of relevant documents. There are two important findings from this study. First, that along with Indonesia democratic transformation, the old fear of state censorship and sanction has gradually waned. On the other hand, however, Law No.40 of 1999 on the Press has not yet managed to give the necessary protection to the members of the Press. In many cases, journalists would still have to yield to the interests of their employers, who often seek personal gratification at the expense of journalistic objectivity.
