IMPLIKASI DUKUNGAN PARTAI POLITIK SEBAGAI PERSYARATAN KEPALA DAERAH TERHADAP KEPEMIMPINAN KEPALA DAERAH

Pasal 18 Undang-Undang Negara Republik Indonesia Tahun 1945 menyatakan hubungan antara terbentuknya negara kesatuan Republik Indonesia adalah dengan mengedepankan otonomi daerah. Dalam pasal 18 ayat 4 UUD 45 demokratis diartikan sebagai pemilihan langsung sebagai mana prinsip one man one vote dalam praktek demokrasi. Negara Indonesia merupakan Negara Kesatuan yang menganut asas desentralisasi. Desentralisasi memberikan kesempatan dan keleluasaan kepada daerah untuk menyelenggarakan pemerintahan daerah. Salah satu unsur penyelenggara pemerintah daerah adalah Kepala Daerah. Fungsi dan peranan Kepala Daerah terus berkembang dari waktu ke waktu. Keberadaan partai politik dimulai sejak dikeluarkannya maklumat pemerintah tanggal 3 november 1945 yang memberikan kesempatan yang seluas luasnya kepala rakyat untuk mendirikan partai politik. Sebagai salah satu persyaratan kepala daerah tatanan normatif ingin mewujudkan terpilihnya calon pemimpin yang dapat melaksanakan otonomi daerah dengan kepemimpinanya. Namun dalam kenyataannya peranan partai politik dalam sistem pemilihan kepala daerah hanyalah sebagai kendaraan politik calon saja. Berdasarkan hal tersebut maka Penulis melakukan penelitian ini dengan tujuan untuk mengetahui dan menganalisis implikasi dukungan partai politik sebagai persyaratan kepala daerah terhadap kepemimpinan kepala daerah. Pada penelitian ini penulis menggunakan metode penelitian yaitu penelitian normatif, sehingga data yang digunakan adalah data pustaka atau data sekunder. Data sekunder yang digunakan terdiri dari bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier. Dari hasil penelitian kemudian dilakukan pengolahan data dan analisis. Sebagai electoral support system dukungan partai politik tidak lantas dapat menjadi goverment support system apabila tidak dipenuhinya persyaratan lainnya sebagaimana terdapat pada Pasal 7 Undang-Undang No. 8 Tahun 2015. Karena dalam pelaksanaanya di kemudian hari, calon dari dukungan partai politik tidak lagi hanya sebagai wakil dari partai politik namun sebagai kepala pemerintahan daerah yang mana didalamnya utamanya kepentingan untuk rakyat dan hasil dari proses kerjasama dari seluruh unsur penyelenggara pemerintah daerah.

Article 18 of the Law of the Republic of Indonesia Year 1945 states the relationship between the formation of the unitary Republic of Indonesia is to promote local autonomy. Unitary State of Indonesia is a country that adheres to the principle of decentralization. Decentralization provides the opportunity and flexibility to the regions to organize regional administration. One element of local government is the Regional Head. Function and role of Regional Head continue to evolve over time. The existence of political parties starting from the issuance of government edict dated 3 November 1945, which provides an opportunity widest breadth of the head of the people to establish political parties. As one of the requirements of regional heads normative order wants to realize the election of leaders who can implement regional autonomy with its leadership. But in reality the role of political parties in the system of local elections only as a political vehicle candidate only. Based on that, the author conducted this study with the aim to identify and analyze the implications of the support of political parties as a prerequisite for regional head against the leadership of the head region. In this study, the authors use the method of research is the study of normative, so that the data used is the library data or secondary data. Secondary data used consisted of primary legal materials, secondary law and tertiary legal materials. From the research then performed data processing and analysis. As electoral support system does not necessarily support a political party can be a goverment support system when not fulfilling other requirements as contained in Article 7 of Law No. 8 Year 2015. Because in its implementation at a later date, the candidate of the political party support is no longer just as a representative of a political party, but as the head of the regional administration in which there primarily for the benefit of the people and the results of the cooperation of the whole element of local governments.
