PEMENUHAN HAK KEPERDATAAN ANAK ANGKAT DALAM PENGANGKATAN ANAK DI YAYASAN SAYAP IBU YOGYAKARTA

Pada zaman sekarang ini maraknya terjadi pengangkatan anak yang dilakukan secara illegal dan tidak sesuai prosedur PP NO. 54 Tahun 2007 tentang Pengangkatan Anak. Permasalahan hak anak angkat terjadi ketika di kemudian hari anak angkat tersebut tidak memiliki status dan asal usul yang jelas untuk pemenuhan hak keperdataannya. Tidak terpenuhinya hak keperdataan anak maka akan menyebabkan permasalahan yang sangat fatal bagi anak angkat. Oleh karena itu, penulis melakukan penelitian tentang PEMENUHAN HAK KEPERDATAAN ANAK ANGKAT yang dilakukan oleh Yayasan Sayap Ibu Cabang Yogyakarta terhadap anak angkat yang diberikan dari orang tua kandung, orang tua angkat maupun Yayasan Sayap Ibu. Penelitian ini bertujuan untuk mengetahui dan menganalisis pemenuhan hak keperdataan anak angkat dari orang tua kandung maupun orang tua angkat yang diberlakukan di Yayasan Sayap Ibu Cabang Yogyakarta serta untuk mengetahui dan menganalisis bagaimana perlindungan hukum terhadap masa percobaan pengangkatan anak yang diberikan oleh Yayasan Sayap Ibu Cabang Yogyakarta. Penelitian ini merupakan penelitian kualitatif yang bersifat yuridis-empiris dengan studi kepustakaan dan studi lapangan, hasil penelitian ini menunjukkan bahwa pemenuhan hak keperdataan yang dilakukan oleh Yayasan Sayap Ibu telah menjamin hak-hak anak angkat agar status hukumnya sebagai anak angkat tidak terabaikan. Hal ini dapat dilihat dari perlindungan hukum terhadap masa percobaan yang diberikan oleh Yayasan Sayap Ibu yang bersifat preventif yaitu untuk mencegah terjadinya hal-hal yang tidak diinginkan dan adanya penetapan pengadilan dalam setiap pengangkatan anak sehingga pemenuhan hak keperdataan anak disamakan seperti anak kandung yaitu dengan mendapatkan pendidikan, nafkah, kekuasaan orang tua dan pewarisan sesuai sistem hukum yang diberlakukan oleh orang tua angkat. Today, there are many cases of adoption those were done illegally and did not comply with Government Regulation No. 54 of 2007 concerning Child Adoption. Problems of rights arise when adopted children does not have a clear status and origins for fulfilling their civil right in the future. Unfulfillment of civil rights in adopted children will leads to many fatal issues. Therefore, author studies FULFILLMENT OF CIVIL RIGHTS ON ADOPTED CHILDREN in Sayap Ibu Foundation Yogyakarta Branch; cases are from biological parents, foster parents as well as from Sayap Ibu Foundation. This study aims to identify and analyze the fulfillment of civil rights of the adopted children from both biological and foster parents which was applied at the Sayap Ibu Foundation Yogyakarta branch as well as to identify and analyze how the legal protection of probation period in adoptions granted by the Sayap Ibu Foundation Yogyakarta Branch. This research is a qualitative study with both juridical-empirical literature and field studies; the results of this study indicate that compliance with civil rights committed by Sayap Ibu Foundation has guaranteed the rights of adopted children so that their legal status as adopted children is not neglected. It can be seen from the legal protection in preventive probation period given from Sayap Ibu Foundation; it is to prevents undesirable things and there is a court order in each adoption cases so that the fulfillment of their civil rights is equal to biological children; which are: to get an education, income, parental authority and inheritance according to the legal system imposed by the foster parents.
