Thesis ini akan menjelaskan bagaimana pola kepatuhan Indonesia terhadap ICCPR dan kaitannya dengan penerapan Hukuman Mati di Indonesia. Penerapan eksekusi mati Indonesia ini berada ditengah Perkembangan norma HAM tentang penghapusan (abolisi) hukuman mati yang gencar digaungkan oleh PBB juga oleh actor non-negara seperti Amnesti internasional, Tesis ini akan memulai pembahasan dengan menganalisis proses dan alasan serta logika apa yang dipakai Indonesia dari mulai mengapa Indonesia meratifikasi ICCPR dan disisi lain tetap menerapkan Hukuman mati. Mengacu pada negara Indonesia yang telah berkomitmen dengan telah meratifikasi perjanjian ICCPR dan juga sudah melakukan legalisasi kedalam undang undang dalam negeri. Logika tersebut memunculkan pola kepatuhan yang dilakukan oleh Indonesia dalam menjalankan peraturan dan kebijakan rezim internasional. Dalam thesis ini penulis melihat bahwa meskipun terdapat pola kepatuhan Indonesia terhadap ICCPR tetapi Indonesia cenderung tidak patuh terhadap norma-norma ICCPR dan terdapat faktor-faktor yang mempengaruhi ketidakpatuhan tersebut faktor-faktor tersebut berkaitan dengan enforcement yang ada dan diterima oleh Indonesia

This thesis will explain how patterns of compliance to the ICCPR by Indonesia and its relation to the application of the death penalty in Indonesia. Application of executions Indonesia is among the development of human rights norms on the elimination (abolition) of the death penalty vigorously echoed by the United Nations as well as by actors non-states such as Amnesty International, this thesis will begin the discussion by analyzing the process and the reasons and logic of what to wear Indonesia from the start why Indonesia ratified the ICCPR and on the other hand continues to apply the death penalty. Referring to the state of Indonesia was committed to have ratified the ICCPR and also have done legalization into domestic law. The logic led to a pattern of compliance undertaken by Indonesia in implementing the rules and policies of the international regime. In this thesis the authors see that although there are patterns of adherence to the ICCPR Indonesia but Indonesia tend not adhere to the norms of the ICCPR and there are factors that affect the non-compliance with these factors relating to enforcement that existing and accepted by Indonesia
