ANALISIS YURIDIS MENGENAI PENOLAKAN AMERIKA SERIKAT TERHADAP HAMID ABOUTALEBI SEBAGAI PERMANENT REPRESENTATIVE IRAN UNTUK PBB

Penelitian ini bertujuan untuk menganalisis penolakan Amerika Serikat terhadap Hamid Aboutalebi sebagai permanent representative Iran untuk PBB dan apa saja upaya yang dilakukan Iran sehubungan dengan hal tersebut. Keberadaan organisasi internasional telah memunculkan praktek hubungan diplomatik diantara negara dan organisasi internasional. Dalam masalah ini berkaitan dengan keterwakilan negara dalam organisasi internasional, menjadi praktek umum di PBB bahwa negara anggotanya akan membentuk Misi Tetap di wilayah markas besar dan menunjuk permanent representative sebagai kepala dari Misi Tetap tersebut. Metode dalam penulisan hukum ini adalah penelitian secara normatif empiris yang menggunakan data sekunder. Penggunaan bahan hukum meliputi bahan hukum primer, sekunder dan tersier melalui teknik pengumpulan berupa studi pustaka. Pendekatan yang digunakan adalah pendekatan perundang-undangan. Data yang diperoleh kemudian dianalisis secara kualitatif. Berdasarkan Headquarters Agreement, Amerika Serikat memiliki kewajiban untuk tidak melakukan tindakan yang menghambat representative negara anggota PBB yang hendak memasuki Amerika Serikat menuju wilayah markas besar tempat Misi Tetap berada. Namun, pada akhirnya tindakan Amerika Serikat dapat dibenarkan berdasarkan ketentuan-ketentuan yang menjadi pengecualian terhadap kewajiban tersebut. Di pihak Iran, sekalipun telah mengajukan protes ke UN Comittee on the Relation with the Host Country upaya tersebut tidak memberikan hasil yang diharapkan. Sehingga, Iran harus menunjuk permanent representative yang baru.

The purpose of the research is to analyze the refusal of the United States towards Hamid Aboutalebi as permanent representative of Iran to the United Nations and any efforts made by Iran in relation with it. The existence of international organizations has led to the practice of diplomatic relations between the states and international organizations. In this issue relates to the representation of states in international organizations, it became common practice in the United Nations that the member states will establish the Permanent Mission in the headquarters and appoint a permanent representative as a head of the Permanent Mission. The method of the research is normative empiric that uses secondary data. The use of legal materials includes primary, secondary and tertiary legal material through the library research gathering technique. The approach uses statute approach. Then, the data obtained will analyzed qualitatively. Under the Headquarters Agreement, the United States has an obligation to shall not impose any impediment to the representative of the United Nations member who wish to enter United States to the area headquarter where Permanent Mission is located. However, the actions of the United States can be justified under the provisions that is exception of its obligation. On the other hand, Iran has protested to UN Comittee on the Relation with the Host Country but these effort did not give the expected results. Therefore, Iran must appoint a new permanent representative.
