EFEKTIFITAS PELAKSANAAN FUNGSI PENGAWASAN DEWAN PERWAKILAN RAKYAT DAERAH DALAM MEWUJUDKAN PRINSIP CHECKS AND BALANCES (Studi Kasus DPRD Kabupaten Boyolali dan Pemerintah Kabupaten Boyolali)

Penulisan tesis ini bertujuan untuk mengetahui efektifitas pelaksanaan fungsi pengawasan Dewan Perwakilan Rakyat Daerah (DPRD) terhadap pemerintah daerah di Kabupaten Boyolali dan Mengetahui efektifitas DPRD dalam melaksanakan fungsi pengawasan dan hubunganya dengan perwujudan prinsip checks and balances. Metode penelitian yang digunakan adalah metode empiris, yaitu penelitian yang dilakukan dengan cara meneliti bahan hukum yang merupakan data primer atau disebut dengan penelitian lapangan (field research) atau sering pula disebut penelitian yang bersifat sosiolegal, yaitu penelitian yang menggabungkan antara pendekatan hukum dan pendekatan sosial. Berdasarkan hasil penelitian dan pembahasan Pelaksanaan fungsi pengawasan DPRD terhadap Pemerintah Kabupaten Boyolali. DPRD Kabupaten Boyolali menempatkan diri selaku kekuasaan penyeimbang (balanced power) yang mengimbangi dan melakukan kontrol efektif terhadap Kepala Daerah dan seluruh jajaran pemerintah daerah diwujudkan dalam tiga tahap pertama Advokasi Kepentingan Masyarakat, kedua Representasi dan Berbicara Kepentingan Masyarakat dan ketiga Pengawasan Administratif. Ketiga Hal tersebut diimplementasikan ke dalam fungsi-fungsi DPRD sebagaimana diaturan dalam peraturan perundang-undangan yaitu Dalam Fungsi Legislasi, Dalam Fungsi Anggaran dan Fungsi Pengawasan itu sendiri. Pelaksanaan pengawasan yang efektif DPRD dapat mewujudkan prinsip Checks and Balances. Efektifitas pengawasan oleh DPRD terhadap pemerintahan daerah beserta jajarannya yaitu dengan terciptanya good governans di segala sektor pemerintahan. Keserasian hubungan DPRD Kabupaten Boyolali dan Pemerintah Daerah Boyolali terjalin dalam setiap pelaksanaan urusan pemerintahan. Eksekutif dan legislatif paham akan wilayah tugas dan fungsinya masing-masing. Hubungan kemitraan keduanya juga bersifat saling berhubungan (inter-koneksi), saling tergantung (inter-dependensi), dan saling mendukung sebagai satu kesatuan sistem dengan memperhatikan cakupan kemanfaatan dalam mencapai tujuan pemerintahan daerah

This thesis aims to investigate the implementation of the supervision function of the Regional Representatives Council (DPRD) to the local government in Boyolali and knowing the effectiveness of Parliament in carrying out oversight functions and its relations with the embodiment of the principle of checks and balances. The method used is the empirical method, the research done by examining legal material which is primary data, or socalled field research or sometimes referred to research that is sosiolegal, the research combines the approach of the legal and social approach. Based on the results of research and discussion of implementation of the oversight function of Parliament to the Government of Boyolali. Parliament Boyolali put themselves as the power balance (balanced power) are offset and carry out effective control of the Regional Head and all levels of local government realized in the first three hap Public Interest Advocacy, Representation and Talking second and third Administrative Public Interest Supervision. Third It is implemented into the functions of Parliament as at legalicy in legislation that is Supervision In Functions Legislation, Monitoring and Implementation In Bugeting Function Control Function itself. The implementation of effective supervision of Parliament can realize the principle of checks and Balances. The effectiveness of supervision by Parliament of the regional administration and its staff is the creation of good govermens all sectors of government. Harmonious relationship Regency Boyolali and Local Government intertwined in every implementation of government affairs. Executive and legislative understand the territory duties and functions of each. Partnerships both also are interconnected,interdependence, and mutual support as an integrated system with regard expediency in achieving the objective coverage of local government.
