Peran Notaris Menjamin Kepastian Hukum dalam Pemberlakuan Sistem Administrasi Pendaftaran Jaminan Fidusia Secara Elektronik

Penelitian mengenai peran notaris menjamin kepastian hukum dalam pemberlakuan sistem administrasi pendaftaran jaminan fidusia secara elektronik bertujuan untuk mengetahui dan mengkaji kontribusi cyber notary dalam pendaftaran jaminan fidusia online demi terwujudnya pelayanan hukum bagi para pihak dalam pelaksanaan sistem administrasi pendaftaran jaminan fidusia secara elektronik. Tujuan lain yang ingin diperoleh adalah untuk mengetahui dan mengkajiperbandingan antara sistem pendaftaran jaminan fidusia secara manual, dengan sistem administrasi pendaftaran jaminan fidusia secara elektronik pada tahun 2013 dan pada tahun 2014. Penelitian ini bersifat deskriptif analitis. Penelitian dilakukan melalui penelitian kepustakaan dan lapangan. Hasil penelitian dianalisis secara kualitatif. Hasil penelitian disajikan secara deskriptif. Hasil penelitian menunjukan. Kontribusi cyber notary terhadap sistem administrasi pendaftaran jaminan fidusia secara online besar, tetapi belum begitu dirasakan oleh notaris di Kota Kupang. Dikarenakan pemahaman hokum yang minim masyarakat kota kupang akan pentingnya pendaftaran objek jaminan fidusia yang di haruskan pemerintah.ada sejumlah persamaan antara pendaftaran manual dan sistem online pada tahun 2013 dan tahun 2014 dalam rangka menjamin penegakan hukum dalam jaminan fidusia, yaitu terkait dengan konsep dan prinsip pendaftaran jaminan fidusia, kedudukan penerima fidusia sebagai kreditur preference, serta kekuatan eksekutorial dalam Sertifikat Jaminan Fidusia.

This research is descriptive. The study was conducted through literature and field research. Results were analyzed qualitatively. Results of the study are presented descriptively. The research shows. Notary cyber contribution to the system of registration online fiduciary big, but not so perceived by the notary in the city. Due to the lack of legal understanding by the people of Kupang. the importance of objects registration fiduciary guarantee that the government may impose. there are a number of similarities between the manual registration and online systems in 2013 and 2014 in order to guarantee the rule of law in a fiduciary, which is associated with the concepts and principles of registration of fiduciary, fiduciary receiver position as a creditor preference, as well as strength in the Certificate Fiduciary executorial.
