TANGGUNG JAWAB NOTARIS TERHADAP PENDAFTARAN KARYAWAN NOTARIS SEBAGAI PESERTA BADAN PENYELENGGARA JAMINAN SOSIAL (BPJS) DI KOTA YOGYAKARTA

Penelitian ini bertujuan untuk mengetahui dan mengkaji tanggung jawab Notaris terhadap pendaftaran karyawannya sebagai peserta Badan Penyelenggara Jaminan Sosial (BPJS) di Kota Yogyakarta, hambatan yang dihadapi, serta upaya untuk mengatasi hambatan tersebut. Penelitian ini menggunakan pendekatan yuridis empiris. Data yang digunakan adalah data primer dan data sekunder. Data primer, adalah data yang diperoleh dari lapangan dengan cara wawancara, sedangkan data sekunder diperoleh dari literatur dan perundang-undangan. Data yang diperoleh dianalisis secara kualitatif selanjutnya disajikan dalam uraian bersifat deskriptif. Hasil penelitian menunjukkan bahwa: 1) Tanggung jawab notaris terhadap pendaftaran karyawannya sebagai peserta BPJS di Kota Yogyakarta, belum seluruhnya dipenuhi. Namun notaris tidak harus bertanggung gugat, karena belum ada pengaduan dari karyawan maupun masyarakat, sehingga belum ada sanksi yang dikenakan terhadap notaris. 2) Hambatan-hambatannya adalah kurangnya pemahaman dan tingkat kesadaran notaris dan karyawannya mengenai jaminan sosial, asumsi bahwa risiko pekerjaan karyawan tidak berbahaya, penghasilan notaris tidak menentu, serta hambatan kurangnya sosialisasi dari BPJS 3) Upaya yang dilakukan adalah, BPJS DIY melakukan sosialisasi,serta berkoordinasi dengan pemerintah Kota Yogyakarta, dalam hal pengenaan sanksi tidak mendapat pelayanan publik tertentu kepada pemberi kerja selain penyelenggara negara yang tidak memenuhi tanggung jawabnya. Sanksi ini meliputi perizinan terkait usaha, izin tender proyek, izin mempekerjakan tenaga kerja asing,izin perusahaan penyedia jasa pekerja/buruh, izin mendirikan bangunan.

The aims of this research to learn and to analyze the responsibility of a notary towards his employees' participation in the social security program provided by the Indonesia Social security Agency, in Yogyakarta, theirs obstacles and finally to solved the problems faced. This research uses a juridical-empirical approach. Both primary and secondary data will be used. Primary data refers to those that are directly obtained in actuality through interviews, while secondary data refers to those obtained from literature and regulations. These collected data will be analyzed qualitatively and presented in a descriptive format. The result of the research shows that: 1) A notary responsibility towards his employees participation in the social security program provided by Indonesia Social security Agency has not yet fulfill in accordance with prevailing laws and regulations. However, there have not been any complaints made by both employees as well as the public and therefore penalties have yet to be imposed. In this sense, a notary should not be accounted as an employer, as the duties entailed to the aforementioned title have not been met. 2) The obstacles include a lack of knowledge or understanding on the matter, a lack of awareness found in both notaries as well as their employees on the social security program provided, the assumption that the work done is not hazardous, the fluctuating nature of a notary income and a lack of socialization by the Board of Social Security representing office in Yogyakarta. 3) Efforts to solve include a socialization approach and education on the program by the Board of Social Security representing office in Yogyakarta, and coordinating with the local government in imposing a sanction of prohibiting certain public services to employers, other than government officials, that do not fulfill their responsibility to register himself and his employees to the social security program, which includes providing the correct and complete data on himself and his employees. This sanction includes business licenses, licenses required to join a tender offer, licenses in hiring foreign workers, business licenses for service providers, and construction permits.
