PERAN ORGANISASI IKATAN NOTARIS INDONESIA KABUPATEN SLEMAN DALAM MEMBERIKAN PERLINDUNGAN TERHADAP NOTARIS DALAM PROSES PEMANGGILAN OLEH PENYIDIK

Penelitian ini bertujuan untuk mengetahui dan menganalisis bentuk perlindungan terhadap Notaris yang diberikan oleh organisasi Ikatan Notaris Indonesia Kabupaten Sleman, mengetahui kendala organisasi Ikatan Notaris Indonesia Kabupaten Sleman dam memberikan perlindungan terhadap anggotanya. Penelitian ini dilakukan dengan metode pendekatan normatif empiris, penelitian normatif mencakup penelitian terhadap sistematika hukum dan taraf sinkronisasi hukum, serta empiris terdiri dari penelitian terhadap identifikasi hukum (tidak tertulis) dan penelitian terhadap efektifitas hukum. Hasil penelitian dari rumusan masalah yang pertama yaitu bentuk perlindungan hukum yang diberikan oleh Ikatan Notaris Indonesia Daerah Kabupaten Sleman dalam menyikapi Notaris X dan Notaris Y sebagai anggota organisasi yang mendapat pemanggilan oleh penyidik adalah pendampingan secara fisik. Pendampingan dilakukan dengan dasar Nota Kesepahaman Antara Kepolisisan Negara Republik Indonesia Dengan Ikatan Notaris Indonesia Nomor : 01/MOU/PP-INI/V/2006 yang dibuat pada tanggal 9 Mei 2006. Secara umum terdapat 4 (empat) bentuk perlindungan yang diberikan oleh Ikatan Notaris Indonesia Kabupaten Sleman yang pertama membuka wawasan notaris, kedua memberikan pertimbangan hukum, ketiga melakukan pendampingan fisik, dan keempat mediasi. Kendala INI dalam memberikan perlindungan yang pertama kendala yuridis yaitu notaris dilarang meraangkap jabatan sebagai advokat, kendala kedua kendala non yuridis terbagi atas dua faktor pertama faktor intern notaris bersangkutan menganggap pemanggilan oleh penyidik adalah suatu yang negatif dan akan mencoreng nama baik sehingga organisasi sulit mendapatkan informasi yang sebenarnya, kedua Kesibukan dari pengurus organisasi INI khususnya bidang perlindungan profesi, yang juga menjabat sebagai notaris yang harus menjalankan profesinya

This study aims to identify and analyze the form of protection for notaries provided by Indonesian Notary Association in Sleman District, as well as discovering the constraints that this organization encounters in providing such protection. This study was conducted by using an empirical normative approach. A normative study comprises the study of systematics of law and the level of legal synchronization. Meanwhile, an empirical study consists of identification of (unwritten) law and the study of the effectiveness of the law. The result regarding the first objective showed that the protection provided for notary X and Y that had been summoned by police investigators had been in the form of in-person assistance providing or sending a member(s) of the notary association to accompany the notaries during the process. Such protection is done on the basis of the Memorandum of Understanding between the Indonesian National Police and the Indonesian Notary Association No. 01/MOU/PP-INW2006 that was made on May 9, 2006. In general, there are actually four forms of protection that are provided by the Indonesian Notary Association in Sleman District, which comprise giving enlightenment, giving legal advice, providing in-person assistance, and providing mediation. In relation to the second objective, this study found that there are juridical and non-juridical constraints encountered by the notary association in providing legal protection for their members. The first constraint implies that it is prohibited for any member of the association to have two positions, a notary and an advocate. The second constraint can refer to the reluctance of the notary being questioned to share comprehensive information to the organization. This is because such a notary thinks that being questioned by the police is embarrassing and would tarnish his profession as a notary. In addition, this constraint can also refer to the busy schedule of the committee members of the organization, particularly the members who deal with profession protection and are also notaries.
