PERAN RUMAH SAKIT DALAM PELAKSANAAN PERATURAN MENTERI KESEHATAN REPUBLIK INDONESIA NOMOR 269 TAHUN 2008 TENTANG REKAM MEDIS DI RUMAH SAKIT UMUM DAERAH LIWA KABUPATEN LAMPUNG BARAT

Penelitian ini bertujuan untuk mengetahui dan menganalisa peran Direksi Rumah Sakit Liwa Kabupaten Lampung Barat dalam upaya pembinaan dan pengawasan pelaksanaan Peraturan Menteri Kesehatan Republik Indonesia Nomor 269 Tahun 2008 tentang Rekam Medis di Rumah Sakit Umum Daerah Liwa Kabupaten Lampung Barat serta untuk mengetahui dan menganalisa akibat hukum dan bentuk pertanggungjawaban Rumah Sakit Umum Daerah Liwa Kabupaten Lampung Barat terhadap penyelenggaraan rekam medis yang tidak lengkap sebagaimana diatur dalam Peraturan Menteri Kesehatan Republik Indonesia Nomor 269 Tahun 2008 tentang Rekam Medis. Penelitian ini merupakan penelitian hukum normatif empiris yang menggunakan data sekunder dan data primer melalui penelitian kepustakaan dan penelitian lapangan. Lokasi penelitian lapangan di RSUD Liwa Kabupaten Lampung Barat. Data primer diperoleh dari subyek penelitian sedangkan data sekunder diperoleh dari studi dokumen, penelitian ini dianalisis dengan metode kualitatif dan dipaparkan secara deskriptif. Hasil penelitian menunjukan bahwa belum pernah dilakukan upaya pembinaan dan pengawasan terhadap pelaksanaan Peraturan Menteri Kesehatan Nomor 269 Tahun 2008 tentang Rekam Medis. Bentuk perlindungan yang diberikan rumah sakit kepada tenaga kesehatan berupa membuat peraturan-peraturan internal rumah sakit, melakukan pembinaan baik etika maupun profesionalisme bagi tenaga perawat, pelatihan, penganggaran dana guna kepentingan pelatihan baik di dalam maupun di luar rumah sakit, dan memberikan asuransi bagi tenaga medis.Berdasarkan hasil tersebut, maka kesimpulannya adalah bahwa direksi RSUD Liwa belum berperan secara optimal dalam upaya pembinaan dan pengawasan pelaksanaan Peraturan Menteri Kesehatan Nomor 269 Tahun 2008 tentang Rekam Medis. Akibat hukum atas penyelenggaraan rekam medis yang tidak lengkap akan ditanggung oleh rumah sakit sepanjang tenaga kesehatan sudah melaksanakan tugasnya standar operasional prosedur berlaku di rumah sakit.

This research aims to know and analyze the role of Director of the hospital in liwa of west lampung regency in an attempt of coaching and supervision of the implementation regulation of the Health Minister number 269 of 2008 on Medical Record in the regional general hospital in liwa of west lampung regency and also to know and analyze the legal consequences and accountability form the regional general hospital in liwa of west lampung regency against the holding of incomplete medical record as set forth in the regulation of the Health Minister number 269 of 2008 on Medical Record. This research was the normative-empirical legal research using secondary data and primary data through the research library and field research. The location of the field research at the regional general hospital in liwa of west lampung regency Primary data obtained from research subjects while secondary data obtained from studies of documents, This research was analyzed using qualitative methods and explained in the descriptive. Research results showed that had never done an attempt coaching and supervision toward the implementation regulation of the Health Minister number 269 of 2008 on Medical Record. A form of protection provided by the hospital to the health personnel includes making the internal regulations of the hospital, doing coaching ethics and professionalism for nursing personnel, training, budgeting funds to the benefit of training both within and outside the hospital, and provide insurance for medical personnel. Based on these results, it can be concluded that the Director of the hospital has not functioned optimally in an attempt coaching and supervision of the implementation regulation of the Health Minister number 269 of 2008 on Medical Record. Legal consequences over the conducting of incomplete medical record will be borne by the hospital for health personnel has done their job according to standard operating procedure that apply in the hospital.
