Penelitian ini bertujuan untuk mengetahui dan menganalisis Pelaksanaan Kontrak Kerjasama antara PT. X selaku Konktraktor Kontrak Kerja Sama (KKKS) dengan PT. BRL selaku perusahaan penyedia jasa di sektor perkapalan dalam menunjang kegiatan ekspolorasi di lepas pantai dan bentuk-bentuk perlindungan hukum yang diterapkan oleh para pihak dalam pelaksanaan kontrak kerjasama manakala terjadi wanprestasi. Penelitian ini bersifat analitis, dengan pendekatan yuridis empiris dan yuridis normatif yang dilakukan dengan menggunakan cara penarikan sampel purposive sampling, yaitu dengan mengambil sampel dari responden yang terkait dengan permasalahan yang diteliti. Responden dalam penelitian ini yaitu PT X selaku Perusahaan KKKS dan PT. BRL selaku Perusahaan Penyedia jasa Perkapalan yang juga menunjang kepentingan KKKS di area offshore. Pengumpulan data dilakukan dengan cara wawancara dan studi dokumen. Hasil penelitian menunjukkan bahwa Pelaksanaan Kontrak Kerjasama antara PT.X dengan PT. BRL mengikuti ketentuan Pedoman Kerjasama Buku Kedua (PTK) : 007-revisi-2/PTK/IX/2011 Jo Buku Kedua PTK-007/SKKO0000/2015/S0 tentang Pedoman Pengelolaan Rantai Suplai Kontraktor Kontrak Kerja Sama yang ditetapkan oleh SKKMigas. Pembentukan Kontrak carter kapal menggunakan kontrak baku dimana klausula-klausula dalam kontrak ditetapkan terlebih dahulu oleh PT. X selaku perusahaan pengguna jasa, sehingga lebih melindungi kepentingan PT. X selaku pengguna jasa dibandingkan dengan PT. BRL selaku perusahaan penyedia jasa. Hasil Penelitian juga menunjukan bahwa Pelaksanaan Perlindungan Hukum dalam kontrak terdiri dari diberlakukannya Penyerahan jaminan pelaksanaan bagi perusahaan penyedia jasa, pengenaan sanksi Penalti atas ketidakpatuhan bagi perusahaan, pemutusan hubungan kerja lebih awal dan penyelesaian sengketa melalui Badan Arbitrase Nasional Indonesia (BANI)

This study aims to identify and analyze the implementation of the Cooperation Agreement between PT . X as Kontraktor Kontrak Kerja Sama (KKKS) with PT . BRL as service providers in the shipping sector in supporting exploration in offshore activities and other forms of legal protection applied by the parties in the implementation of the contract when the event of default . This research is analytical , empirical juridical and normative juridical approach is done by using purposive sampling sample withdrawal method , which takes sample of respondents associated with the problems studied . Respondents in this study are PT X as KKKS Company and PT . BRL Company as Shipping Service providers that also support the KKKS interest in the offshore area . The data was collected by interview and study of documents. The results showed that the implementation of the Cooperation Agreement between PT.X with PT. BRL following the Second Book of the Code provisions Cooperation (PTK): 007-revision-2 / PTK / IX / 2011 Jo Second Book PTK-007 / SKKO0000 / 2015 / S0 of Supply Chain Management Guidelines Contractor Cooperation Contract stipulated by SKKMigas. Contract formation of charter boats using standard contract in which clauses stipulated in the contract in advance by PT. X as enterprise service users, thus better protect the interests of PT. X as users of services compared with PT. BRL as service providers. The research also shows that that the implementation of the Law on the Protection of the contract consists of the implementation of a performance bond for the delivery of service providers , the imposition of sanctions for noncompliance penalty for the company , early termination and settlement of disputes through theIndonesian National Arbitration Board ( BANI )
