PROSES PERSERTIPIKATAN TANAH DARI BENTUK LETTER C KE SERTIPIKAT HAK MILIK

Setelah keluarnya Undang-Undang Nomor 5 Tahun 1960 Tentang Undang-Undang Pokok Agraria, maka banyak perubahan yang terjadi dalam ketentuan hak-hak atas tanah. Salah satunya adalah di adakan konversi hak atas tanah oleh pemerintah. Konversi hak atas tanah adalah penyesuaianhak-hak atas tanah yang pernah tunduk kepada system hukum lama yaitu: hak-hak tanah menurut Hukum Barat dan tanah-tanah yang tunduk kepada Hukum Ada tuntuk masuk dalam system hak-hak tanah menurut ketentuan Undang-Undang Pokok Agraria. Tujuan dari konversi hak-hak atas tanah tidak lepas dari tujuan yang hendak dicapai Undang-Undang Pokok Agraria yakni unifikasi dan kesederhanaan dalam hukum pertanahan serta untuk memberikan jaminan kepastian hukum mengenai hak-hak atas tanah dan terciptanya kemakmuran, kebahagiaan dan keadilan bagi Negara dan rakyat. Secara lebih khusus konversi bertujuan untuk mengadakan unifikasi hak-hak atas tanah, sehingga kelak tidak ada lagi hak-hak atas tanah produk Hukum.

After the release of Act No 5 of 1960 about basic agrarian law, there are so many changes in spulation of land ownership right. One of them is condicted the conversation of land ownership right by government. Conversion of land ownership right is an adaption of land ownership right which have been submissive to the old system of law, that is land ownership right according civil law and adat law to be included in system of land ownership right according to spulation of basic agrarian law. The purpose of conversion of land ownership right is never separated of the goal of basic agrarian law that is unification and simplicity in agrarian law and to give guarantee of certainty of law about land ownership right and creat prospertty, happiness, and justice to country and citizen, specifically, the goal of conversion is to unification of conversion is to conduct unification of land ownership right, so that, there's no new legislation later.
