INTISARI Permenakertrans Nomor 19 Tahun 2012 tentang syarat outsourcing membawa perubahan besar terhadap pelaksanaan serta struktur bisnis pada perusahaan jasa outsourcing. Perlu adanya penulisan hukum mengenai dampak riil yang terjadi dari pemberlakuan Permenakertrans 19/2012 yang merubah syarat badan hukum bagi perusahaan jasa outsourcing menjadi wajib PT. Metode penelitian yang digunakan pada penulisan hukum ini dengan cara wawancara lansung pada Narasumber yang merupakan salah satu Board of Director dari perusahaan Business Process Outsourcing dan wawancara beberapa Responden dari pihak karyawan yang diambil secara random. Data dari hasil wawancara yang diperoleh dikaji dengan memperhatikan ketentuan dalam UU 13/2003 tentang ketenagakerjaan, UU 40/2007 tetang perseroan terbatas, dan Permenakertrans 19/2012 tentang syarat-syarat outsourcing. Data lain yang digunakan adalah hasil survei dari KPPU dan Kemendag, serta artikel terkait perusahaan Narasumber. Analisis yang dilakukan dari data yang diperoleh kemudian di jabarkan dengan cara Normatif-Empiris. Hasil yang diperoleh dari penelitian serta analisis kualitatif yang dilakukan, ditemukan bahwa pada masa transisi aturan selama 2 tahun awal pemberlakuan Permenakertrans 19/2012 menimbulkan sedikit celah hukum yang dapat dan telah dimanfaatkan oleh para perusahaan jasa outsourcing. Dengan adanya celah hukum, menjadikan sebagian kecil dari perusahaan jasa outsourcing yang sudah menjadi PT, secara cepat menguasai pasar jasa pekerja outsource,dimana sebagian besar perusahaan jasa outsourcing sisanya justru mengalami kerugian besar. Keuntungan yang diperoleh salah satu perusahaan jasa outsource yang diteliti bisa mengambil alih 35% pasar jasa pekerja outsource dan peningkatan omzet lebih dari 200% dalam kurun waktu 2 tahun sejak didirikan.

ABSTRAK Permenakertrans No.19/2012 on the terms of outsourcing bring big changes, on the implementation and business structures in outsourcing services company. It need for legal writing about the real impact that occurs from the application of Permenakertrans No.19/2012 which changing requirements of legal entity for companies outsourcing services become mandatory PT. The method used in the writing of this legal writing by means of direct interview on the informant is one of the Board of Directors of the companies Business Process Outsourcing and interview some of the respondents of the employees were taken at random. Data obtained from interviews assessed by taking into account the UU 13/2003 on manpower, UU 40/2007 on limited company, and Permenakertrans 19/2012 concerning the terms of outsourcing. Other data used are the results of a survey of the Commission and the Ministry of Trade, as well as articles related to enterprise resource persons. Analysis conducted from data obtained later on describe the way Normative-Empirical. The results of the research as well as qualitative analysis, it was found that the transition rules for two years the start of the Permenakertrans 19/2012 pose little legal loopholes that can be and has been exploited by outsourcing services company. With the existence of legal loopholes, making a fraction of the outsourcing services company that already limited company structure has rapidly become a market leader of workers outsourced services, where the majority of the remaining outsourcing services company experienced a huge loss. Gains derived by one of the companies surveyed outsource services can take over 35% of market services outsourced workers and an increase in turnover of more than 200% within 2 years since it was founded.
