Pelaksanaan Perjanjian Kredit Antara Pegawai Yayasan Insan Mandiri Denpasar dan Koperasi Kredit Insan Mandiri Denpasar dengan Jaminan Hak Atas Gaji

Penulisan hukum ini berfokus pada pelaksanaan perjanjian kredit pada Koperasi Kredit Insan Mandiri Denpasar. Secara khusus, penulisan hukum ini bertujuan untuk mengetahui keabsahan suatu perjanjian kredit yang dilaksanakan pada koperasi, apa saja permasalahan yang ditemukan dalam pelaksanaan perjanjian kredit tersebut dan bagaimana penyelesaian masalah apabila terdapat debitur yang pensiun, mengundurkan diri atau meninggal dunia padahal angsurannya belum lunas. Data yang diambil oleh penulis diperoleh dari hasil wawancara kepada pihak Koperasi Kredit Insan Mandiri Denpasar dan kepada 5 (lima) orang anggota koperasi yang pernah melakukan perjanjian kredit dengan pihak Koperasi Kredit Insan Mandiri Denpasar dimana anggota tersebut memberikan jaminan hak atas gaji mereka. Berdasarkan dari hasil penelitian yang dilakukan oleh penulis, maka masih adanya kasus wanprestasi yang terjadi dalam pelaksanaan perjanjian kredit pada Koperasi Kredit Insan Mandiri Denpasar dimana bentuk wanprestasi yang terjadi adalah debitur memenuhi prestasi tetapi tidak tepat waktu. Semua kasus yang terjadi berupa debitur tidak melunasi hutang pada koperasi sesuai dengan waktu yang ditentukan di dalam perjanjian kredit yang disepakati sebelumnya. Koperasi Kredit Insan Mandiri Denpasar dalam melindungi haknya terkait pemenuhan prestasi debitur khususnya dalam kasus dimana debitur mengundurkan diri, pensiun atau meninggal padahal angsurannya belum lunas, koperasi akan bekerjasama dengan pihak ketiga untuk menjamin haknya tersebut.

This law writing focuses on the execution of credit agreement on Denpasar Insan Mandiri Credit Cooperation, especially, this law writing intends to know the legalization of credit agreement which is done on the cooperation, any problems found non the execution of the credit agreement, and intends to know how to solve the problem whenever the debtor retires, resigns, or passes away (dies), whereas his/her installment has not been fully paid. The data which are taken by the writer are obtained from the interview result with the Denpasar Insan Mandiri Credit Cooperation, and from 5 (five) members of the Cooperation who has done credit agreement with the Cooperation, and who has given his/her salary as a warrant. Based on the result of the research done by the writer, there still occurs some cases breach of contract in the execution of the credit agreement, in which the form of breach of contract happened is that the debtor fulfills the performance, but not on time. All the occuring cases are in the form of the debtor who has not fulfilled his/her debt to the cooperation in accordance to the time determined in the previous credit agreement. Denpasar Insan Mandiri Credit Cooperation in securing its right dealing with the fulfillment of debtor performance, especially in cases, in which the debtor resigns, retires, or passes away, whereas his/her installment has not been fully paid, so cooperation will cooperate with the third side to guarantee its right.
