Tinjauan Yuridis Terhadap Daftar Negatif Investasi Indonesia Berdasarkan Peraturan Presiden Nomor 39 Tahun 2014 dalam Menghadapi Masyarakat Ekonomi ASEAN (AEC) 2015

Masyarakat Ekonomi ASEAN (AEC) 2015 merupakan kerjasama ekonomi antar negara ASEAN dengan tujuan utama yakni liberalisasi perdagangan termasuk liberalisasi investasi. Memasuki masa AEC, penting adanya usaha pengamanan sektor vital perekonomian Indonesia salah satunya dengan adanya peraturan yang berguna untuk mengklasifikasikan daftar bidang usaha yang tertutup dan bidang usaha yang terbuka dengan persyaratan di bidang penanaman modal yang dikenal dengan Daftar Negatif Investasi (DNI). DNI bersifat dinamis, dapat dievaluasi atau direvisi mengikuti perkembangan, Sehubungan dengan perubahan DNI 2014 ini, terdapat beberapa sektor usaha yang kian terbuka dan ada yang semakin tertutup. Keterkaitan pelaksanaan DNI dan AEC 2015 perlu dikaji pemberlakuannya, terlebih karena adanya perbedaan semangat liberalisasi dan bebas terbuka AEC dengan asas keseimbangan kemajuan dan kesatuan ekonomi nasional yang mana menuntut untuk mempertahankan sektor usaha yang vital milik Indonesia. Penelitian hukum ini merupakan jenis yuridis-empiris, dengan menggunakan studi pustaka dan penelitian lapangan untuk menjawab masalah- masalah hukum. Dalam studi pustaka, tinjauan literatur dilakukan pada undang- undang, peraturan, dan bentuk literatur lainnya. Selain itu, penelitian lapangan dilakukan dengan mewawancarai responden yang merupakan staf bagian biro hukum dan deregulasi Badan Koordinasi dan Penanaman Modal (BKPM). Data yang diperoleh dianalisis menggunakan pendekatan deskriptif kualitatif untuk disimpulkan. Berdasarkan hasil penelitian ini, penulis menyimpulkan bahwa terdapat dua prinsip utama pada DNI 2014 yakni prinsip negative list dan grandfather clause. Ketentuan-ketentuan yang diatur di ACIA telah diakomodir baik pada DNI 2014, namun masih ada beberapa kelemahan dalam sistem penyusunan dan pengawasan DNI 2014. Dalam hal perlindungan, DNI 2014 telah dirasa cukup baik dalam mengamankan sektor vital nasional terlebih pada sektor UKM.

ASEAN Economic Community (AEC) in 2015 is economic cooperation between ASEAN countries with the main purpose of trade liberalization, including liberalization of investment. Entering AEC, it is important to have safeguards to protect all vital sectors of the Indonesian Economy, one of it is by initiate the rules that are useful to classify a list of closed business field and opened business field with the requirements in the field of investment, which known as Indonesia Negative List (NL). NL is dynamic, it can be evaluated or revised depends with the following developments. Regarding the changes of 2014 NL, there are some sectors tend to be more open and some of it tend to be more closed. Linkage between NL implementation and enforcement of AEC 2015 is need to be reviewed, especially because of the differences between the spirit of liberalization and free open in AEC with the principle of balance of progress and national economic unity which requires to maintain vital business sector belongs to Indonesia. This legal research is juridical-empirical kind, by the use of library research and field research to answer the legal problems. In the library research, literature review was conducted on laws, regulations, and other form of literatures. Additionally, the field research was conducted by interviewing respondents who are the law and deregulation staffs of Indonesia Investment Coordinating Board (BKPM). The data obtained are analyzed using qualitative-descriptive approach to make into conclusions. Based on these results, the authors conclude that there are two main principles of the NL in 2014 the principle of the negative list and the grandfather clause. The provisions set forth in the ACIA has been accommodated on the NL in 2014, but there are still some weaknesses in the preparation and monitoring systems NL 2014. In terms of protection, DNI 2014 has been deemed good enough to secure the vital sectors of the national especially in the SME (Small and Medium Enterprises) sector.
