Upaya Perlindungan Hak Paten Proyek Akhir Mahasiswa Diploma Teknik Elektro Sekolah Vokasi Universitas Gadjah Mada

Hak Paten merupakan suatu hak yang diberikan oleh negara kepada inventor di bidang teknologi berdasarkan ketentuan Undang-Undang Nomor 14 Tahun 2001 tentang Paten. Penggunaan hak paten dari berbagai karya teknologi di Indonesia dapat berlaku bagi teknologi yang diperbaharui maupun teknologi yang benar-benar baru ditemukan. Inovasi teknologi juga dapat ditemukan oleh siapapun dari berbagai kalangan. Undang-undang tidak membatasi inovasi teknologi dalam hak paten. Namun demikian, adanya perlindungan hukum hak paten dan tuntutan kemajuan teknologi Indonesia tidak dibarengi dengan adanya kesadaran akan perlindungan tersebut. Proyek akhir maupun karya-karya mahasiswa yang bersifat inovatif dan inventif belum dilindungi sesuai dengan amanah Undang-undang. Khususnya pada proyek akhir mahasiswa Diploma Teknik Elektro Sekolah Vokasi Universitas Gadjah Mada. Hal inilah yang menjadikan penulis tertarik untuk mengkaji mengenai implikasi perlindungan hukum terhadap proyek akhir mahasiswa yang berbasis teknologi dan seharusnya dapat dilindungi dengan hak paten. Pada penulisan hukum ini, penulis menggunakan metode deskripftif kualitatif, dimana dengan metode ini peneliti akan menggambarkan keadaan, fakta-fakta, dan data yang searah dengan rumusan masalah sehingga secara deskriptif akan menggambarkan keadaan sesuai perkembangan dalam rumusan masalah tersebut. Adapun teknik pengumpulan data dalam penulisan hukum ini adalah dengan metode studi kepustakaan dan wawancara (interview). Metode studi kepustakaan didapatkan dengan mengkaji buku-buku, peraturan perundangundangan, dan literatur lainnya. Terhadap metode wawancara akan dilakukan bagi narasumber di bidang hak kekayaan intelektual, mahasiswa diploma teknik elektro universitas gadjah mada yang pemilik proyek akhir namun belum didaftarkan hak patennya, serta narasumber lain yang berkaitan dengan penulisan. Kesimpulan dari penulisan hukum ini adalah mengetahui penerapan perlindungan hak paten bagi proyek-proyek akhir mahasiswa Diploma Teknik Elektro Sekolah Vokasi Universitas Gadjah Mada yang belum dilindungi sebagaimana mestinya, sehingga proyek akhir yang sudah dibuat dapat bermanfaat baik bagi perkembangan teknologi pada internal UGM maupun bagi kepentingan industri di luar UGM. Patent is a right granted by a state to an inventor in the field of technology under the provisions of Act No. 14 of 2001 on Patents. The use of patents on various technologies work in Indonesia can apply to the updated technology and the technology is really new is found. Technological innovation can also be found by anyone from all walks of life. The law does not limit the technological innovation in the patent. However, the protection of copyright law and the demands of technological progress Indonesia is not accompanied by the awareness of such protection. This is what makes the writer interested to study the implications of the legal protection of students' final projects based technology and should be protected by patents. In legal writing, the author uses qualitative deskripftif method, which with this method the researcher will describe the circumstances, facts, and data are in line with the formulation of the problem so descriptively will describe the state according to the development in the formulation of the problem. The data collection techniques in the writing of this law is the study of literature and interview methods (interview). Methods of literary study obtained by studying books, legislation, and other literature. Against the interviews will be conducted for a resource in the field of intellectual property rights, electrical engineering diploma student university Gadjah Mada the final project owner but has not registered its patent rights, as well as other sources associated with the writing.
