Tujuan penelitian mengenai “Tanggung Jawab Pemegang Merek Agen Properti Terhadap Komplain Dari Konsumen Di Kota Denpasar Dan Kabupaten Badung” adalah untuk mengetahui secara pasti tanggung jawab hukum apa yang akan diberikan oleh agen properti kepada konsumen yang komplain dan apa hak-hak konsumen itu. Penelitian ini merupakan penelitian hukum emperis yang juga didukung pula dengan penelitian di normatif untuk mengetahui bagaimana pemegang merek agen properti itu bertanggung jawab terhadap konsumennya dan apakah kewajiban tersebut dilaksanakan sesuai peraturan dan perundang-undangan yang berlaku. Dari hasil penelitian diperoleh kesimpulan bahwa : 1. Komplain dari konsumen di Kota Denpasar dan Kabupaten Badung terjadi karena: a. kurang hati-hatinya agen properti melakukan negosiasi dari penjual selaku pemilik ...... properti dengan calon pembeli, karena kadang pemilik properti yang tidak mau memberikan atau menunjukkan asli bukti kepemilikan property sehingga transaksi jual beli tidak dapat dilaksanakan. b. kurangnya pengetahuan agen properti dalam memahami dokumen properti yang ...... ditransaksikan, sehingga menimbulkan kerugian bagi pembeli selaku konsumen. 2. Praktek Tanggung Jawab Pemegang Merek Agen Properti Terhadap Komplain Dari Konsumen Di Kota Denpasar Dan Kabupaten Badung pada umumnya dilaksanakan dengan baik dan profesional mulai dari mengantar konsumen ke lokasi properti yang akan ditransaksikan, negosiasi harga, cara pembayaran, dokumen yang dimiliki dan semua persyaratan lainnya yang wajib dipenuhi baik oleh pemilik properti maupun konsumen selaku pembeli/penyewa sampai terjadinya transaksi hingga selesai. 3. Dalam hal konsumen dirugikan karena kesalahan ataupun kelalaian agen properti, maka agen properti wajib bertanggung jawab memberikan ganti rugi kepada konsumennya sesuai dengan ketentuan yang diatur di dalam Undang Undang Perlindungan Konsumen.

The research concerning of “Responsibility Of The Trade Mark Holder Of Property Agent Against The Consumer Complain In Denpasar City And Badung Regency” was to find out what is the legal responsibility should be given by the Property Agent to the consumer when complain and what is the consumer rights. This is an empirical legal research and also supported by a normative legal research to examine how the trade mark holder of property agent has to responsible to the consumer and whether the said duty have been executed according to the regulation and prevailing the law. Based on a the result of research, it can be concluded that: 1. Complain from the consumer in Denpasar city and Badung Regency could be happened caused of : a. careless attention the property agent to make negotiation from the seller as the owner of property with the buyer, who would not give or show the original of property document, then can not be executed the transaction. b. careless the knowledge of the property agent in understanding of property document which would be executed, then caused loss of the buyer as the consumer. 2. Practice of Responsibility Of The Trade Mark Holder Of Property Agent Against The Consumer Complain In Denpasar City And Badung Regency generally was executed correctly and professional concerning of to show the property location, negotiate the price, how to make the payment, the ownership of the document and all other conditions should be fulfilled by the property owner and consumer as the buyer/lessee until final the transaction. 3. In the event the consumer was got loss cause of the false or negligence of the property agent, then the property agent has to responsible and give compensation to the consumer according to the term in the Consumer Protection Acts.
